It might sound expensive for you but it's on par for around my parts and I've had other automotive parts painted before as well and it does not sound ludicrous at all. Not to mention this is going to cost me time and effort to be driving between shops to repair and paint the items. I'm not settling for less than my previous number of $925, replacement injector and excess shipping amount. I'm not going to go back and forth when I've been more than reasonable on this matter. If you disagree, we can just let the chargeback handle it. I'll ship you the whole kit and kaboodle when my bank returns the whole amount.

I can't believe Avex is quibbling over $125 here. Even using the original $6500 sale price that doesn't include the excess shipping amount paid, that's less than 2% of the sale. Avex, that's not a lot to resolve a sticky situation here....

It's actually not $125. We are $425 or so apart. His replied stated $800 total. Which means he's not replacing missing injector($105), excess shipping(~$195) and the $125 you mentioned.

In my opinion, the seller should accept full responsibility of the broken parts. I had a similar situation happen to me on e90post, where I was the seller. The shipping was delayed for 2 weeks, out of my hands however I still took responsibility. I sold coilovers for $750, I refunded $200 to the buyer due to inconvenience alone. That was also the last "gift" payment I accepted. Now I offer to split the fees with everyone.

$125 on an almost $6500 sale is nothing, also keep in mind that he is selling the complete car for over $40k. Mostly I am upset that he didnt mention that the car was supercharged when I asked him about the car.

Since you made this matter public on an open forum here's some advice to the seller and buyer. If either of you really want to resolve this do so professionally and pick up the darn phone and settle it like men. This back and forth over the internet coupled with everyone's assessment of who's wrong or what should have been done is not helping IMO...just saying.

+1. Why is this a thread? And how come everyone comes out of the woodwork to offer their opionions on what to do.

BTW, all the legal BS aside, seller has no issue here other than not insuring a shipment worth insuring. Once you drop something to a shipper it falls into their custody/control and any damages arising from shipping are not sellers fault. Move on, stop bickering on the forum. This place is not looking good.

Are you serious? Just in case you are, here are the answers:

1: It's a forum, so unless it's against the rules, there's no reason why it can't be a topic/thread.
2: My initial intention for starting this was to inform the general population of the experience I had with a particular seller. I did not anticipate any response from the seller since he's gone radio silent. It's also why I went ahead and pursued my other recourse. And the fact that there's some type of traction on the issue, it proves that putting it in front of the community had a positive impact on the situation.
3: Since the seller has responded, I am updating the thread so that readers don't just assume that the seller left it at that and there's actual progress and possibly a resolution(we do not know at this point).
4: Seller is in China and we've not been able to get on the phone during a convenient time for both of us and therefore we've decided to communicate in this manner. His inbox was full, so I replied here. Once again for full disclosure.
5: Is this our first time on a forum? It's a community where people voice opinions on an open thread. Don't like it? Don't read it and move on.
6: Your point on shipping is not entirely accurate.
7: Of ALL the threads on this forum, this is the one that makes it look bad? Lol. Once again, if you don't like that people are able to discuss openly on a forum, move along. I'm sure there's other kumbaya places you can visit.

Not mentioning that the car had a supercharger is pretty shady. i wouldn't mind buying a car like that but full disclosure vs 'not mentioning' something that important is a sign of his Character.

That is the most asinine thing I have read in quite some time.

I am pretty sure (I will give you the benefit of the doubt and not try to seem like I am 100% sure I know what I am talking about) that this is what insurance is for, and the seller opted to take a gamble and save a few bucks, and lost. Not buying insurance alleviates any interest the shipper has in this matter. Which means either the buyer or the seller are responsible for the damages. So I ask, between the two, why should the buyer be responsible? Did he damage the items? The seller was the one responsible for packaging, shipping, and insuring the box to ensure it arrives to the buyer in one piece, and he failed to do one of the three, so it's his problem to deal with and make right.

Why is that so hard to understand?
