Is this Class Action Lawsuit only for the US ? Or also Euro and Worldwide related ?
Think best thing would be to sign-in... and also for people without BF ,it's strange because I see nothing to sign-in ?

i'm thinking BMW hasn't done this yet due to cost of addressing the issue. if you read the link one of my earlier posts. The car was out of warranty, guy had a lawyer. BMW ended up paying off his loan and legal fees, on top of giving him 51k for his car, substantially more than an 08 would be on the market with 72k miles. I'm thinking they were paying off the guy rather than let the issue become a bigger problem if he would of went to court and it would have been a reference case for others who had the rods blown.
This was settled due to California's lemon law. This wouldn't apply to the majority of us.

I know of several local individuals not even on the forum that had failures. This is long overdue! Subscribed.

Okay that makes sense.

I actually understand how the engine can lock up but haven't ever seen it be a problem in these caaes.

How you can die from failure
My engine blew up on the Autobahn at around 150 mph. I couldn't see shit because of all the smoke and I'm pretty sure the people behind me didn't see anything either (looked in my mirrors, all I could see was literally only thick white smoke). All systems broke down (DSC, ABS, ...) and oil was spilling on the tarmac. I was lucky enough there was an exit to a gas station right then and there so I changed lanes (from all the way left) and let the car roll to the parking lot next to the gas station.
It was also kind of busy that day. People behind could've also been at risk (not seeing anything, oil spill, sudden braking, ...). I had to slow down and change lanes while not seeing anything behind me. Luckily nothing happened.

What about a Change.org site to begin identifying the class members? I think the bad publicity could be more powerful than anything else.

I agree, bad publicity is very powerful and could get BMWs attention faster than lawyers could.

Why not start with the attorney whose client was able to get BMW to buy back the M3 and cover his legal fees? Seems like this guy is doing something right.

Throttle actuators are covered under the California emissions warranty law and should have been replaced for free. Why did you pay for them?

I emailed a few attorneys today, my personal attorney said he wasn't interested as he doesn't do this type of case (he is interested if it ever happened with me individually though), another one said they didn't do class action suits, awaiting for a reply from the rest. There is an attorney who is a member of my civic club that I will be seeing today and will get in touch with him tonight. If we gather information/fata as we can I think would help and this entire forum is gold mine for it.

WOW ! What a story ! Think you was very lucky that day !
I said this several times on here , it's a true miracle no one is killed.... untill the present day with all these BF !
BTW...You had not once BF...but twice BF , and now you're on your third S65 !
Imagine your situation...
That's why....Good luck with your third S65 , and think you need a double thumb =>

As an attorney I read this with some interest. The problem as I see it is that the class is small, the risk is high so few decent class action lawyers would be interested. So unless you got a hybrid case (low hourly plus 20%) instead of the usual 33-40% it ,might be hard to find good counsel. This case would require a bank of at least 50-100k to fight, with large chunks going to experts. The other issue I see is how many of the 66 documented failures were on modified or tracked engines. From just watching the threads, many were and this excludes any recovery.

So if 50 non-modded victims want to pony up $1,500 each, I'll talk to my class action guy about filing in Florida Federal Court and see what shakes out.
