Item Interest
2011 E92 M3 for sale. 62,xxx miles, car is completely stock. Car was driven as a daily, selling because I'm moving and no longer need it.

Salvage title, car was completely inspected prior to purchase, no frame damage and is mechanically sound. Always maintained by 412 Motorsports in Baldwin park. No lights on the dash, just passed SMOG.

Some people have a weird aversion to certified checks from banks as if fake checks are a widespread ongoing issue. I had a deal fall through because a guy wanted $40,000 cash, like in an envelope. I asked him if that was a normal amount of cash he deals with in his daily life.

more of a chance of the cash being fake than a certified check.

I concur and in every car sale I have done it's been at the bank which has two benefits: one, they can immediately check on a bank check/cashiers check for status, and if it's cash, they can verify the count and check for any counterfeit bills.

If they cannot verify the check, then I will either cancel the sale or tell the person I will not give up possession of the car and won't sign the title over until the check clears.

It is difficult to safely purchase a car private party.

1. Cash can be seized by cops without legitimate cause and in most states (still) you have to sue to get the money back. In many cases, people don't get it back. Ever. Not to mention how difficult it is to get $40k in bills! My bank asks me to order the cash 2 weeks in advance if I want anything over $5k.

2. Cashier's checks can be cancelled, even if they are "verified" by the bank. It takes at least a few days for the actual transfer to happen, and during that time, the buyer can cancel the check -- even though the funds are verified.

3. Wire transfers are required by law to post by the next business day, but banks still play games with this. Depending on the bank, they may claim that the business day ends at 2 PM (or earlier) for wire transfers and therefore sit on the money for a couple of days.

As I'm sure everyone knows, dealers handle these issues by simply holding onto the title until the money is in their hands. I've bought/sold a lot of cars over the years, and I'm starting to think that is the best way. For a private sale, it works like this:

1. The seller does all due diligence to verify the funds are on the way.

2. The buyer and seller fill out the title. This ensures that a) there is in fact a title and b) the sale takes place on paper.

3. I always also notarize a bill of sale.

4. The buyer drives away with the car.

5. The seller mails the title after funds clear.

Other than that, I don't know what to do anymore. Escrow service, maybe.

UPDATE

My move to the east coast was delayed hence the pardon on actually selling the M3, but bumping this back up as she's still for sale.

Due to an abundance of interest and a few outstanding offers from when I first posted the car, price is firm. Car will be sold to whoever snags it first on a FCFS basis.

Transaction will be done at a bank, cash or bank certified check work.
