Need Your Help!!!!!!!!!!!!!!!!!!!!!!!!

So here is the situation at hand; I have a 08 M3 E90, I have had it since April, leased....since then It has been in the shop 3 times..

1st time: diff bolt in front mount broke; fixed under warranty (thats the clunk i was hearing)

2nd time: 5 months later, same exact thing happened again, this time I had aftermarket wheels on, the tech said they wouldn't warranty that problem again because the wide tires and 19 inch wheels "put excessive tension on the differential mounts" but fixed this time under warranty. They delivered the car to me from WV over here in Lexington Ky (go to school here) after they parked the car and handed me the keys............we have a ........

....3rd time: the SAME EXACT THING happened again, right after they fixed my car, 45 minutes after the guy delivered my vehicle from the shop, but guess what, the aftermarket wheels are still on it

So I guess my questions relate to the lemon law. Lemon Law sais that if the same non-conformity happens 3 or more times, or your vehicle is out of service for a accumulated 30 days for the same problem, within a year of acquiring vehicle, BMW is responsible for granting me a new comparable vehicle....

Here are my questions:

Am I covered under the lemon law even though they voided that part of my warranty due to aftermarket wheels? If they deny, my arguement would be that it happened with the stock ones on before; would this be a legit arguement to present to officials (bmw, lawyers, court...so forth)??????

If so, does the lemon law cover leased vehicles?

If not, where should I go from here? I obviously have a lemon, but am not covered by the lemon law; my car stays in the shop more time that I have to enjoy the vehicle!

What should I do!!??? This is all new to me, I've never had to deal with something like this!

Dude, i feel sooooo sorry for you. Unfortunately the only thing i can offer is kind words, b/c i'm not familiar with lemon laws. One thing i remember that the dealer told me after asking about aftermarket rims is that as long as the size is comperable you're in the clear.
You mentioned that the wheels are 19's so that is ok, since Bmw also has that size. How about the width?

Good luck with the lemon law.

You broke the diff bolt three times. Do you believe that is a material flaw with the car? Maybe once, but not three times.

There has to be someting else wrong with this car for it to break 3 diff bolts! the third one 20min after the second one went in.

Something is out of alignment, who else here has had this bolt broken or come loose?

I get what you're saying but it's also completely possible that there is something else broken that is causing the diff bolt to break. It -may- not be abuse, we can't really say for sure based on what we know.

Was there a post, 2 to 3 months ago, about a diff that fell off?

Check the specs of your aftermarket wheels to the specs of the factory BMW 19 wheels option. If they are the same in diam and width and close in weight then there is no way that the dealership can claim failure because of aftermarket rims.

Better off saying what it does not have and that's a B&O Audio System, otherwise all option boxes are ticked.
