Lot's of questions are being raised. Let me answer a few.
First of all, I've got the money to buy the car in the bank. I hope I've established that. I also had arranged for financing to buy the car because even with the money in the bank, with low interest rates it makes sense to buy a car by financing it. That opportunity was taken from me by Lincoln BMW when they refused to honor the auction results last week. On Monday, when they claimed the deal could go through on conditions (one of which was an impossibility -- that I stop the press from writing about this), I decided to retain legal counsel and I also decided to lease the car. I obtained approval for the lease yesterday. So those people who don't think I am going to buy the car, or that I just want the publicity, or that I am just playing games don't know what they are talking about. I know a dealership in Lincoln, Nebraska they could work for. But maybe they already do. Second, in my lawyer's letter to Herb Klein at BMWNA, he was suggesting that maybe BMWFS would like to step up and get me a better lease deal. We've never heard from BMWNA, so I guess the only thing they're concerned about, other than their dealers is warranty claims. BMWNA never stepped up to anything. Third, I am going to a BMW meet this Sunday in Calabasas. The reference to it in my lawyer's post here was what is called "irony." Obviously there's no way I can get the M3 by then, although if I were Lincoln BMW I'd hire out a 747 to get it to me and end the bad publicity. But that's their choice. (I would have thought they'd at least step up and agree to ship it to me for free after all the problems, but now they are insisting on the letter of the agreement. But that's okay with me. That's all I ever wanted.) Fourth, my lawyer did not want me to have to contact Fil Catania again -- nor did I -- but the other lawyer insisted on it, and it gave Fil one last chance to show who he is. It takes 2 to tango, and because I wanted to put the deal together I was willing to go the extra mile. Obviously I was the only one on the field at the time willing to run with the ball. Fifth, my posts have been uneven because I have been out of town and have posted many times from my handheld while I was on the road. (I did pull off to the side first.) Also, until I got Scott to help me, I was pretty stressed out. Sixth, if I had not hired Scott you can see the impasse I'd still be in. The dealer wanted me to singlehandedly "stop the presses" and "contain the publicity." I don't know how to do that. And it also wanted me to keep everything confidential. Two conflicting demands, one of which was impossible. Both conditions on the sale. And, now, you are being told by the dealer's lawyer that I was not timely in sending them the deposit. A deposit they refused to take. Does "Catch 22" ring a bell? Anyway, the deal is supposed to be completed tomorrow and my credit card (information sent to Mr. Maledon by Scott) was charged the deposit. So all I have to do is fill out the paperwork. But it seems strange that after acting as it had Lincoln BMW now tries to pull its chestnuts out of the fire by offering my car to someone else. Seems awfully cheesy to me. Thanks for your support. As soon as I have the car I will post photos on this site and you can all see that both I and it are real. I plan to have the vehicle shipped to a local BMW dealer to be checked out. Does anybody here have any suggestions? Any local dealership want to get some good PR? (I live closest to South Bay and Long Beach BMWs.)

Im glad you cleared this out for all of us Dooma....Thanks.....So the dealer is not paying for any of your fees???? Im pretty sure you can get more out of this, don't do anything you might regret not doing after....GOOD LUCK and Hopefully no-one will ever buy a car from them again and they will be begging their customers to come back.... dooma350 - hey. I'm really glad this is working out for you the way it should.
I have a curiosity question about the deposit. Couldn't you have made the deposit using PayPal through the auction listing on Ebay? Not that it matters at this point, just a question that came to mind. I think you ought to make the trip to physically inspect the car before it leaves Husker. I wouldn't trust them one iota!!! At the price you're getting I think you oughta buy the car, but, of course, that's your own personal decision. I would have done that, but the dealership conveniently left out paypal as a payment option. If you look back at the screenshot I posted, you'll see it doesnt show a paypal link.

good news to hear ken. NOW I really wonder why dealership would accuse Ken of not paying, he even showed us his financing capabilities.
Indeed I do agree that you should get it checked out by your local dealership. I'm very unsure of all those spills under the bonnet and what Husker would do to the M3 to "get back" at you. Unfortunately, I currently reside in Nashville, Tennessee so I have no idea regarding California dealerships, but I know there are a lot of active forum members from SoCAL, so you should try talking to them. If M3post.com doesn't have many responses, go check out E90post.com as well.

Ive been reading this thread for quite some time... I generally post on the E90 forums...
Dooma, im glad things are starting to look a better. On New years day, i had a dealer deliver the wrong model car. Took a month of hassle to correct it. (At the end, they finally agreed to take the car back and give me the correct car). The dealers were playing innocent twisting the story around during the process so i understand what you are going through. GL with the M3! If things go as according to planned, maybe ill have a E92 M3 in 3years and start posting here regularly |
