Shocked to discover that the car is CPO . . .

Purchased my '08 M3 (with 7,000 mi) privately in 2010 - both the ad and the seller warranted that there had only ever been 1 owner.

Discovered yesterday (while getting the ECU ver. no. from BMW) that the car has a CPO warranty. Huh?

Pretty angry about this misrepresentation from the seller - she was in the fact the 2nd owner, and not the first - though the car was (and still is) in perfect condition.

Weighing the pros and cons of confronting the seller. How would you guys react to something like this?

Would a confrontation be an overreaction? Seems like a pretty dirty trick to pull.

Edit: had full BMW inspection / car fax / etc. before purchasing - not sure how this detail didn't arise.

You new have a CPO warranty? Bonus!!

I wouldn't bother confronting the seller myself.

It depends on how much you like your car and are satisfied with it, and if you think you'll sell it at some point and 3 owners instead of 2 would create diminished value. You don't seem to actually have experienced a problem with the car so it sounds like you'd just be creating a headache for yourself by pursuing the seller (although I sympathize with your feelings of being cheated in some fashion)

Looks like the only mod you have that would really affect warranty is the tune? I'd take off the intake when taking the car in and they will probably never notice the pulleys..

Maybe this is the explanation. She seemed like a very nice person (recently followed up 2 years later to see how the car was doing), and works in the same industry as my dad. She was also aware of the fact that I'm a lawyer.

Not an ideal situation from her perspective in terms of attempting to screw someone.

I'm going to assume that it was an honest mistake, and will let it go.

Wasn't aware that a dealer using a car as a demo was the equivalent of titling it. Always thought that the car is just listed as inventory until they finally sell it to a retail customer.

I bought a demo 6 years ago and it was definitely sold to me as a new car - the sticker was still on it, they started out with new car MSRP (of course negotiated a hefty discount, etc). I never checked carfax or anything like that to confirm I was the first owner

Dealers will CPO their demo / loaner etc cars and sell them as "new" cars. I guess the question I would of asked her was -How many miles did the car have when you 1st bought it?

It sounds like an honest mistake.

Great point! This seems like a ver good possibility. But as others have said...you have some warranty so that's pretty much a bonus in it all.
