For moving violations, your insurance shouldn't go up in you're not at fault. Also, in some states like CA, they can't raise your rates if you're both at equal fault (50/50).

Comprehensive claims, generally won't increase your insurance cost until you do a few of them and the insurance company gets sick of giving you money... but you're usually good for 1-2 freebies before this happens.

In this case, this is a moving violation where the other party is 100% at fault - OP should be in no danger of a premium increase.

I would suspect that the insurance company of the guy you hit is trying to pawn off any costs he can.

Just get the police report and call your insurance company.

Did the airbags go off? How bad is the car? I wonder if the guy that hit you will be underinsured...

Have you attorney obtain a copy of his cell phone record, use the data log to show them what was happening at the time of the accident. Hopefully, you have a police report about the accident. You did call the police, right?

Get the police report and report it to your own insurance company so you can get your car fixed make sure your cars goes to a BMW certified repair place. Let your insurance company worry about who's paying and drive your fixed car and enjoy. Pretty much let your insurance company take care of everything.

This being said, Liberty Mutual FTMFW. Did you know they give great discounts to BMW Car Club Members, and is the BMW preferred insurance? Most people worry about the aftermath of an accident, but god forbid I would have to deploy such resources, I can be confident that they will take care of me.

Its very important to have an agent that you work with from the inception of your insurance contract. You want the relationship to get to the point where you have their cell phone number in the event of an accident. Once you have reached this point, you can generally rest assured that your agent is going to work in your favor, even when his adjuster comes out to "pull your teeth." It never hurts to slip them a 20 every time you see them (how often are you really going to meet your insurance agent? rarely at most)

I apply this same formula with my service adviser at my service center, except sometimes i'll tip him 40 or 50 if its alot of work or if my car requires alot of attention. its the best investment.

Sorry to go off topic but I was in a accident back in Jan. I was the first car in the lane, the light turned green i started to pull forward and a lady ran a red trying to make the light and smacked right into me. I had plenty witnesses and the cop wrote the lady a ticket for being 100% at fault. I contacted an attorney since I was injured. The lady was under insured and only covered for 10k in vehicle damages and 15k in medical. My car was totaled out and I still got 22k for my Lexus and her insurance company is going after her for the other 12k. My medical was more than 15k so that's where my underinsured coverage in my insurance kicked in.

Hopefully you weren't injured at all but if you were get an attorney (a reputable one) and even if the kid has minimum coverage hopefully you have decent uninsured/underinsured coverage in your policy. If you have witnesses make sure you let your insurance company know

Go to the police station complain about what happen with that one guy. If you remeber when the accident happen you can get a lawyer to pull the guys phone record to show that he was texting within that time frame. Then shove it in the insureance faces

Weird.. usually when one car has side impact damage and the other has large front end damage and it's an obvious intersection, typically it's an easy case for the insurance company. Not sure how they can avoid 100% responsibility.

I highly doubt texting while driving will ever stop. They need voice to text messages and messages to voice for all phones imo. Not the best solution but at least it would bring texting while driving down.
