The speed limiter is only in 6th gear. You can max out your 5th gear. I hit 165 the other day in 5th

I wonder if Canadian spec'd cars are the same (without limiter)?

I don't think this is true. I hit 170 in 6th gear without a problem. I'm sure it was more like 165mph actual due to the speedo being a bit optimistic, but the whole 6th vs. 5th gear thing is not accurate.

the book says the US spec M3's are speed limited to 155mph. Has anyone experianced a higher speed in other spec's? European, Canadian, etc M3? Has everyone with US spec M3's gotten the car up past 160mph at least? I've not had a chance to get mine up past 140mph since these roads/highways here suck and there are allot of speed traps/camera's & cops everywhere. I'll have to test this out sometime on a good long highway.

I've hit an indicated 175mph in my US spec e92 M3. I haven't had a chance since the winter hit to verify this w/ a GPS unit, but plan to once springtime comes around. It has been my experience that the M cars seem to have a softer limiter in place than other BMWs. My previous M3 also ran past the 155limit. Granted, there is going to be some error in the speedo, but I can't believe that it would be 20mph off.

Of course, a friend of mine has an e39 M5, and he bounces off his limiter at 155 so who knows.

Error on the spedo doesn't sound like the culprit here.

If that were the case, the M has a false (or "erro-prone") speed calculation for the spedo, and another (non "error-prone") means to calculate speed for limiter purposes.

Just doesn't make sense.

I traded E39 M5 for E92 M3, and I went over 170 mph on M5, but i got the M5 used, so its possible it had limiter taken off.

I haven't found anything in the owners manual indicating a 155 gov speed limiter. The E46 was top speed limted to 155mph but the E90 might be higher (160 maybe). The article does say..."Despite the claimed 155-mph limiter, our test car crept past it to 161 mph."

Yep, reckon there's some speedo error in some observations.

I just drove with a hand held navigation that shows current speed in my 4Runner, and in my M3. The speed in the 4Runner matched what the Nav was showing, but in M3 the speedo was off. While Nav showed 75mph, M3 speedo showed around 83mph.
I am thinking of going to a shop that can officially calibrate speedometers and get a reading of my speedometer. And if it is truly off get, the BMW to FIX it under warranty, what do you guy think?

I read Kingleh's post where he went to Daytona and hit 168mph on his gps so maybe the M does have a higher limiter than they are stating.

As I uderstand it, German TUV regulations require speedometers to never read under true speed, though they are allowed to read over. Therefore, most German makes calibrate to the safe side to allow for tire differences, etc. 8-10% off, as you measured, is not unheard of. In that case, 170mph indicated would be around 155.

I'll have to correct myself here, earlier in my responce I said, "in the manual it states a 155mph limit" I think I got that mixed up with what the 335i's brochure has that I picked up from BMW before purchasing the M3. I can't reference my M3 manual right now as I'm in Italy on leave but I do remember seeing something about the limiter at that speed or I guess it was 161 or 165mph. Can't confirm. But this is interesting about the speedo having an error. So does everyone find that the error is at higher speeds?

What is the purpose of a speed limiter at 161 miles per hour, does an extra 20 mph make you anymore reckless
