As I mentioned in my first post, I secured financing the day of auction end(3/20) thru Capital One Auto Finance. Remember, immediate payment was one of the requirements for this auction. Here is a screenshot of my approval at the lowest rate.

On 3/25, I was approved for leasing (leasecompare) at the lowest money factor. So there you have it, Husker, approval for both financing (traditional) and lease.

Thanks again for sharing your concern about my financial situation.
Its heartwarming to know that you care.

Hi Ken

What has been eBay active involvement/decision -if any- in all of this mess? So far that little detail has not been even mentioned at all in here, other than submitting the initial complaint...

On Monday, when they claimed the deal could go through on conditions (one of which was an impossibility -- that I stop the press from writing about this), I decided to retain legal counsel and I also decided to lease the car.
Whoa, whoa, hold on, nelly. Why would you do this? The entire basis of your (very valid) claim rests on them honoring the agreed upon Ebay deal, which was for purchase, NOT lease. So why would you change mid-stream to a lease, which isn't much different than them trying to change the sale terms after the auction is over? Maybe I'm not understanding what you're saying. Off I go to read the next 10 pages of thread -- hopefully you explain this better somewhere in there.

Dooma! For great justice!

These pics look like FIL has his finger stuck in an electrical socket, which isn't a bad idea in his case!

BEST of luck to you DOOMA. I've read every page of this amazing, epic, saga.

Dooma did mention that he was approved from a third party leasing service. If this is the case, it should make no difference to the dealer, it's not their business if he wants to lease it because the dealer still gets their money regardless. Its not like he's trying to finance or lease it through BMW Financial Services and even then it shouldn't make a bit of difference.

Who cares who pays to the dealer - the bank or the private individual? ... doesn't matter at all.

That UTUBE vid is hillarious.

Wrong...the dealer still gets a $60,000. It does not matter if I bring it to them in $20's, $50's, $100's, $.25's, a certifed bank check drawn on my personal account, a bank check from Capital One that is secured with a lien and structured as a loan OR WITH A CHECK FROM A BANK THAT IS STRUCTURED AS A LEASE...the differences are not material to the seller...unless they want to count my quarters...

Also, while I understand that this tread is long...Dooma350 (Ken) has clearly explained this

Except, that this just an additional way to get hammered by the dealer...they make $$$ on BMWFS deals also...

Don't laugh, yes we have a station wagon . I got a family. Have been lurking for what seems like weeks but is, in reality, only a few days. Thank God I am on spring break. Good luck Ken. Glad to see you seem to be making progress.

It makes perfect sense to me that he would prefer a lease now, after all the bad blood. Fil has no great love for Ken, do you honestly think he is going to treat that car with respect before delivering it? Before they deliver it, they may decide to have a couple of joy rides, red lining the whole way, dumping the clutch, burning up the tires, etc. It it were me getting that car, I'd prefer a lease to protect myself.
