I've noticed the whistle on my 2009 M3 as well. But mine only whistles when it's in gear. Is that the same symptom?

Excellent thread. Op on the rattle I had something similar and it was the underbody shield rattling against the driveshaft. Became loose. Only happened at 2-3000rpm and at certain temperatures.

Lol I have that same problem now. It only rattled at precisely 3000-3200 rpm lol. It's not really noticeable so I'm ignoring it for now >.<

Hmm I could be but I had the whistling in gear or in neutral.

If it's only whistling in gear it could be the butterfly in your idle air controller. Would be dirty and not sealing tight

Your service details mentioned it was covered under the Federal Emissions Warranty. Anyone else have experience with this? Wondering if my out of warranty car can get this replaced.

You will need to call your BMW dealer and see what they say. The emissions warranty usually goes beyond the standard mfg warranty and in CA I believe it's even longer than the regular Fed emissions warranty.

If the other poster got it replaced under warranty then it's a pretty safe bet that all BMW dealers should cover it.

Usually if you bring your car in they won't just go off of what you say... they will do their own diagnosis and probably charge you a diagnostic fee. If they conclude that the problem is indeed covered by warranty they will fix for free and refund your diagnostics fee. If it's not covered warranty then you lose your diagnostics fee and you can then choose to pay whatever fee they are charging to fix the problem or just take your car back.

There was another thread about whistling sound upon acceleration, and there was a crack/split inside the plenum. I took some RTV silicone and patched it up while doing some other work on the car. Whistle is gone.
