What level of force can be used in a dog attack?

We've been kicking around the idea of buying a Labradoodle and we've come across some videos on you tube of pit bulls attacking and even killing dogs and it got us wondering. What exactly is our right when it comes to defending ourselves and our dog in the event of a dog attack? So for humans, we have the right to defend ourselves and even using deadly force when necessary and allowed under certain circumstances of the law. Of course, I realize each state has different parameters of when deadly force can be used so to provide context to my question, we live in CA. I'm no lawyer but as I understand it, in CA you first have to try and avoid the conflict and have a duty to retreat. If you're not able to retreat, I believe you have to basically say stop and then if the treat continues, you have the right to use deadly force. Again, I'm no lawyer.

So when it comes to a dog attack, you can't necessarily retreat like if you're out walking because you can't outrun a dog. If a dog is attacking you and is clamped down on your arm, or leg, or whatever, what can you do within the extent of the law to stop the dog attack? If the dog is attacking your dog, what can you do within the law to stop the attack? Now I will say that if I'm out with my kids and dog and if a dog attacks my kid, I won't even hesitate to stab the dog to death because I would be carrying around and 3in pocket knife or so if I'm walking my dog with my kids. My kids life is undeniably more important than an attacking dog's life and I will not hesitate to use the knife and deadly force to stop a dog attacking my child.

Please note that this is not a question about how to tell the owner of the attacking dog to be a responsible pet owner, of whether pit bulls should be banned or not (I used a pit bull example because that's what came up on you tube as the most common aggressor), or whether Labradoodles are good dogs, etc. I think you get the point. I'm not trying to start an off topic war of words. Just curious to know what my rights would be. Thanks.

I would like to say I've trained police dogs, guard dogs (both killers on command), a seeing eye dog, but my speciality is dogs with problems, and the issue is always at the end of the leash.

I know my dogs and how to train them. I just am not allowed to kick the stupid out of the owners.

You think you are going to kill an attacking pit bull with a 3” pocket knife? Better chance it will lock on your hand or wrist before you have a chance to even swipe at it.

Every place I’ve ever lived has required dogs to be on a leash. If there is a pit bull or any other breed roaming around off leash, I think any human being would be well within their rights to defend themselves, family or pets using whatever means necessary. But I don’t think a pocket knife will help much.

There are plenty of bad dog owners to go around. As you know certain breeds have a very strong natural prey drive and consequently require obedience training. A lot of owners do not put the time or effort into that training and end up with a poorly adjusted dog which will bite. As I said, in the US if one of these maladjusted dogs is off leash and it attempts to bite someone it's game over for the dog. In the US many towns require dogs on a leash when in public.

Side note: In high school there was a grocery store across the street from my school and one afternoon I walked over there to buy a snack before a track meet. . Two little girls were at the edge of the parking lot and one of them had a German Shepherd on a leash. That damn dog took off after me and dragged that poor girl on the asphalt for at least 10 feet. She was too small to walk that dog.

I barely reached safety in a drugstore because the entrance door was not automatic. I'll never forget feeling that dog snapping an my heals as I weave around parked cars. Scary as shit.

If I had a firearm I would've shot the dog rather than praying I could out run it long enough to reach safety. I love dogs, and really love GSD's but it wasn't my fault that 3ft tall little girl had a 85 lbs GSD on a leash.

Hit the dog hard on the nose it will relax him good. I know this from a person that actually had this happen to him. He did this to a germanshaperd when he got atacket, it let go of his leg right away.

When I first read this post I thought you've got to be kidding. I read it again, and read it a third time and all I can say is you've got to be kidding. You are asking a bunch of total strangers to provide you with legal advice. Are you crazy? Do you honestly expect to get worth while legal advice or perspective in a car forum?

California has more than 175,000 licensed attorneys. Go to your local lawyer's referral service and ask for one who specializes in questions of self defense or criminal defense law. Pose your question to that person.

What about just using pepper spray or bear spray? Won’t that deter an attacking dog without killing it?

Some dipshit at my apartment walks around with his pitbull off it’s leash. There have been two times where it has run up on me and my lab and started growling and showing teeth. Once it even tackled my lab and then started showing teeth while on top of her. Both times I had no way of defending myself so I had to wait for the douchebag owner to come take his dog away.

If I had a way to defend myself I would not hesitate to kill that fucking dog.

I have a Pit-Black Mouth Cur Mix (southern hunting dog). She is a wonderful dog and I have trained her well. But no matter how much training you do dogs are animals and can be unpredictable.

Op....if you are that worried about a dog attack then DONT GET A DOG! You need to be able to handle the dog or any situation involving your dog.

My dog has an aggressive Breed in her. She does not get along, for the most part with other aggressive breeds. We’ve had a few instances where other aggressive dogs were off leash and charged at my dog. On both instances I kicked the charging dogs square in the face. This worked and they retreated.

My point is....you need to be a confident pack leader for your dog and embrace that role. Which means protecting when needed. If you are not capable then rethink getting a dog.
