NEED help! Need guidance on how to deal with dealer and shipper of car.
Bought my car unseen (never again) with the understanding that it was "perfect". Granted a used car is never going to be perfect, however when I authorized the dealer to spend $2000 on paint and another $200 on paint correction my expectations were high. Friday the 15th I get my car and it's got several imperfections that I notice right away. Right off the bat I notice several rock chips on the front bumper which I'm willing to look past to get the major problems fixed like one dent on the drivers side door, one major scratch on my drivers side mirror and a door ding on the passenger side back panel. What is my recourse? The dealer is claiming ignorance and isn't willing to claim responsibility and the shipper LSM Transport LLC claims that the car was like that when they got it.

For your next vehicle that you purchase long distance: You always need to have a set of eyes put on the car for YOU. There are members in every state, a lot of them are more than wiling to go and look/test drive an M3 for a forum member. I have done it and I know many others who have done the same. We can debate a PPI whether or not that is important but either one of those things happening or even just one would have prevented/alerted you to this very issue. Dealers absolutely love a buyer taking their word on a sale without having an inspection performed. And look at their half assed nonchalant response to your problem now. I'll bet they were very attentive and responsive before you made the purchase. Don't be surprised if they have caller ID and stop picking up when you call in now that you no longer are any use to them.
As far as today? Name who they are here in your thread so that forum members can avoid them as to not go through what you have. Maybe I'm misreading your OP. You authorized $2,000 for paint and $200 for paint correction? |

I agree with BOOF. Eyes on the car before sale to document any and all imperfections. One guy's idea of "perfect" can be FAR from the idea of perfect to someone else... Especially in the seller's eyes. However, all quality transporters usually mark and identify on their bill of lading any paint scratches/dents for exactly this reason. They don't want to get blamed for pre existing imperfections. If these imperfections are not on their sheet then you *might* have a leg to stand on. Refer to the shippers receipt for details..
Curious though.....What did you have done paint-wise for $2000? |

$2k in paint was due to major scratches and rock chips on the front and rear bumper and hood. I had one member look at it before I bought it and I was reassured by the dealer multiple times that it would be "perfect". I told him at the time of the purchase that my version of 'perfect' was unlike others and I had very VERY high expectations. You are right, before the purchase was made he was very quick to answer my questions and spend my money to make it "perfect" but since then he's been absent at getting this taken care of. I did have another member go look at it after it was done, but that member has since been silent and hasn't replied to my messages.
I have the yellow copy of the BOL but as I said before the shipper claims that the car was like that before it got on the truck. I'm not sure what my recourse is if any..... |

I feel like I was taken for a ride and advantage of. It would be different if the dealer set me up with the expectations that $2k worth of paint and another $200 in paint correct was't going to take care of everything. But what I keep falling back on is the word "perfect". He used that word multiple times and right before I sent him the money for the car I told him I was going to fly out there to see it first and tried to pressure me not to come and I would be happy with the result.

I think you need to dig deeper with the shipper.
1. All reputable shipping companies have insurance to cover damage caused by their employees moving the cars. 2. Because of #1, they always go over the car with a fine tooth comb and make notes on a drawing (like the rental car companies have) of dents, scratches, etc. to specifically defend themselves when situations like yours happen. They cannot simply state, "it was like that when we got it". 3. You need to go back to the shipper and tell them you spent $2k on corrections pre shipment and had an individual inspect pre shipment. If they claim it "was like that" then they need to prove it with pre shipment paperwork. If they prove it was like that, then you can go back to the dealer. If you can't get proof the shipper did/didn't cause the damage then both the shipper and the dealer will just point fingers at each other and you'll get nowhere. |

The dealer did $2,000 worth of paint correction, right? No way they don't have photos after the work. If they don't have photos, as said above, the shipping company knows the condition of every car they transport to avoid blame on such things. Someone, either the dealer or shipper has information they are not sharing. Keep pressing. Go over any pics you have before the vehicle arrived to find some evidence. Good luck with you mission. Hopefully this comes to a good resolution. Nice color choice btw.

Shippers have to fill out inspection forms at the time of pickup of the vehicle and delivery. They mark any little blemishes they see for insurance purposes. When you received the car and signed for it you should've received those inspection forms. Did they mark any of the damage at the time of pickup? If they did then it's on the dealer.

Who did the paint correction? $200 sounds like a shit job, if you had a well known detailer do it, I'm sure he would have been able to tell you where every imperfection was and if that damage was there when he worked on the car.
If you let the a used car dealer choose where to get that work done, then for sure you will get taken for a ride.

I think they legitimately painted the hood, front and rear bumper. But somewhere between bringing it back from the shop and delivery to me it got jacked up.

Sorry to hear about your delivery, Do you still have the original photos of the cars before the paint work and correction, I would think their would be detail photos of the car that would match the current pictures of what you are showing us that would show damages that you can compare the before and after with. Goodluck and hope it gets resolve in a professional manner.
