First, I am so sorry that this has happened to you.. it sucks and makes me feel sick in my stomach. Second, As a similar event has happened to my patents, from a very large company (on forbes 500) infringing my product from design, function, and customers. I would like to share my two cents.
you have a few options 1. If you have a design patent this will greatly increase your chances of winning as the design seems to be the main clause of their "shady" business. 2. If you have Non Disclosure Agreements, manufacturers agreements or any type of contract that forbids them with selling a competing product (any certain manufacturer as it could hurt your sales) or any type of written form of "Good Faith" business this will help you win. 3. You can ask for a preliminary injunction. for an immediate cease of sale. (although not really immediate, this can take 1-2 months) My opinion is they may have copied your product because your exhaust is sold in the market. Your product also could have been reversed engineered. If you have supplied them with sensitive materials, confidential information, drawings, specs that are not used in the open market this can be used against them. Any emails or faxes can also be used against them. Remember even though your company and the general public thinks its copied this is all considered "open information". You can't do anything about it unless you have some sort of agreement between your companies, or have patents that restrict other companies from infringements. I recommend going to trial as the jury would usually favor the obvious instead of the "law". OH yeah you can also sue for bad business practices or ethics! Good luck! I have a warehouse 25,000 sqft.
