That's why you are doing this wrong. You should go through your insurance and have them fight for the settlement for you. Since you are not at fault, this is a fairly slam dunk case. Not sure if you have a deductible with your insurance, but even that can be waived (or credited) on top of your settlement.

Ding ding ding. Similar situation for me. Other party was at fault and their insurance said there was like $9k in damage to repair it (LOL). Got my insurance company involved, explained the situation, and it was totaled the next day with their appraisal.

Push for a total. You do NOT want this car back.

Well... if it is thaaat bad, just like someone said above, just forget about it. I am not really sure, but I actually think that there is no point in repairing it. I would sell it, or place on an auction just like the copart auction or the iaa auctions, as that is the perfect place for this kind of Damaged Car. I have had a similar situation with my older f80, it was totalled by one of my neighbors, and I decided to sell it on an auction. I do not regreat anything about that car, it had a short, but rather interesting live.
