Hi Jason,
Thanks for that. I'm sure that all new BMW's are 50 state cars, but I figured
I'd check what the California DMV has to say (Google is my friend):

So it could still be an issue with some vehicles, but likely not BMW's.

Check near the bottom of the list there. Sure, all new cars (to my knowledge anyway - there may be a precious few exceptions) _can_ be specc'd to California emissions. But some manufacturers actually do have seperate equipment that goes only on California cars, probably because it adds cost.

BMW, I think, builds all cars 50 state legal. But again, I'm not for certain on that. At the very least, there is no Cali emissions equipment on the BMW option list, so that to me says its highly likely all BMW's are Cali legal

The BIN doesn't disappear when someone bids. I haven't posted something for sale in awhile, but it's my understanding that you can change most of the pieces of the auction, as long as someone *hasn't* bid on it.

There was one and only one bid on this particular auction, which meant that the dealership could have changed the BIN as many times as they wanted up until the buyer placed his first bid (which could have been moments before it closed).

just picked up the story from 300zxclub.com link and joined to say good luc to the OP. i do alot of business on Ebay and feel that actions from sellers like these is what is sending the great buyers away.

This is just another example of a small fry salesman (big only in his own mind) not understanding the power of the Internet and it's community. Unfortunately, the dealer made the *stupid* mistake of not honoring the deal and they will pay dearly for it for a time to come! If only a few people don't buy from this dealer as a result of this bad publicity, more monetary loss will have accrued than selling your M3 to you at a price under list!

They have had previous auctions on eBay dating back to 2006, so the "mistake" issue seems more like an excuse. Like most dealerships they were trying to get more significantly over MSRP, and got caught.

The evidence is clear that the dealer's representative monitoring the ad knew exactly what was going on...

On principal alone, it's good to see you have decided to stick with this, even if your time and efforts end up exceeding MSRP. This will have a big impact and may protect others from deceptive trading.

What is up with BMW dealerships? I had a BMW dealership in Boulder, CO (Gebhardt BMW) do a similar thing. Long story but the short version is I went to buy 07 M Coupe they had. They had a price listed on their own website and refused to honor that price. Instead they raised the price by $4k. When I pointed out the price was wrong and that they had a lower price on the website. They used the same old excuse, opps it was a mistake. How convenient that is for dealerships to do that. I also listed a complaint with the BBB. I know nothing will happen but it is good to get the word out about these stealerships.

Best of luck on getting the M3.

Wow. Read through the whole thing! Support here from a zposter and a Canadian!

Exact same thing happened to a friend of mine who won an auction for a Civic on ebay. The guy basically said, "I can't sell it to you for that price. But I can sell it to you for ______" (basically a couple thousand dollars more). My friend basically just let it go even though I told him to fight it. So you're doing the right thing!

I think other car dealerships should pay attention. Yes, dooma, you are right on this, but I think the reason why this is getting so much coverage, support, and outrage is because we've all been screwed or have had a dealer try to screw us at some point in our lives.

If dealers were honest and fair, this backlash wouldn't nearly have been as harsh. I look forward to your getting the M3!!

It took 18+ pages and finally a post that made 100% sense to me....and from a new guy!! Seriouslly...this is spot on. For you very few out there suggesting there was a "mistake" made.....read this guy's post again. First of all, it is highly unlikely that someone would make a mistake with this type of money invloved. BELIEVE ME....THIS GUY TOOK HIS TIME WHEN HE TYPED IN THE NUMBERS TO INITIATE THIS AUCTION!!! Second, the guy could have pulled the M3 from auction FOR 3 DAYS!!!!! Lastly, the dealer called the guy with the "winning bid" within seconds after the auction ended.....because he knew he got burned!!!!

Please stop suggesting that a "mistake" was made....it clearly wasn't.
