I agree that the complaints are typical in the industry. However, the number of complaints at this dealership is more than triple yours over the same time period. I agree though, proving shill bidding could have some very serious consequences--especially using the internet (wires, mail, and interstate commerce) to do it.

Greetings from another Autoblog member.

Ken, this is just crazy...I'd have given up long before now, but you're keeping at it. Good job!

And I've sent this in to Top Gear and a few local TV stations--we'll see if it shows up

Jeebus, what a soap opera this has become. Definately a strange course of events, I'm very curious to see the final outcome.

I just got off the phone with the BMW of Lincoln, Nebraska where I spoke with a fellow we'll call Steve (who didn't want his name released) and he said that that they are 100 percent willing to honor their transaction with Ken Tanisaka once he completes payment.

I asked him what kind of payment would be accepted, and he said "For example, cash." I then asked, "Okay, now just for the sake of argument, If he was to pay via Paypal... would you accept that form of payment?" Steve then said, "Once it clears our account, yes.... We are just waiting for the paperwork to clear."

So it looks like they've had a change of heart. At least I hope so.

I joined just to share this, and hope Ken get his car soon.

make sure you notify the bloghounds about this, and somebody should digg it or something. My luck with submitting stories to blogs isn't that great, perhaps in force...?

At least they're willing to handle it. Not the reaction I was expecting though, I was prepared for some rude guy or a shouting match, at the very least to be hung up on, and this fella only seemed to want all this crap done and over with.

EDIT:

this was for the phone call I had, here for all those who want to read but don't want to flip through pages:

What say ye, net denizens ?? I'll send the first $10.00.

Ken would need to post or send us his e-mail account so we can PayPay it to him....

And, no, I'm not a shill, I've been posting on E90Post since I've owned my E90.

...

I'm all for the guy getting his car, but I think essentially having the Internet community *give* him the car (when he could afford it on his own to begin with), is overreactive and silly.

I know many people (such as myself) can barely afford a $15k car, so that gesture, while well meant, seems... well, dumb.

Why not do as a previous poster suggested and buy the car (if Ken doesn't take it), and donate it to a charity so they can auction off the car to fund its cause? I know many reputable foundations that would delight in this action.

Just my two cents. :P

Is not shill bidding and the like a Federal crime?
If it is they could probably add conspiracy to it also.
(and no telling what else I'm not a lawyer)

Any ideas out there?
Will the internet community forgive and forget about the possibility of shill bidding?

Will a politician or governmental department investigate?

Will eBay take action and slap Husker on its wrist?

Will nothing happen?

Stay tuned to page 127 for more details!

Reads like an episode of the old Batman TV show... but either way, IF shill bidding is going on, someone NEEDS to go to jail and fines NEED to be levied.

I just thought it would make a good story. So, it was a dumb idea.

I do like the charity idea, but Ken is well on his way to buying the car.

Should be accompanied with a list of things the dealership could have bought with the 4K they are losing by having to sell this car under invoice
