That's interesting... I was in an accident where a woman hit the left rear knocking my bumper off. Since she was at fault, my insurance brought out their own appraiser and provided the estimate. My adjuster said I wouldn't need to pay the deductible and my insurance paid up front and the went after her insurance.

If she's at fault, I wouldn't expect you to have to wait for her insurance... your insurance needs to step up. But I guess all insurance companies have their own policies.

Trust me, I am trying, but I have never owned anything and respected it as much as that car. It really sucks. It is easy for the e9x guys to say upgrade and get a new one but I am truly an e46 fan. It is going through her insurance and I have still not heard. Apparently the damages do not qualify as a total loss, but it is close and an adjuster still needs to go have a look. I feel like they are not doing anything. Can I go through my own insurance and have them deal with this or would that not be smart? Would my rates go up more if I decided to go through my insurance? Anyone know?

Do NOT go through your own insurance or even contact them. When I was with Geico, I contacted my insurance twice about possible claims, neither of which Geico ever had to pay out on (one was covered by other driver's insurer other was uninsured motorist that I paid out of pocket to fix). A year later they raised my rates, even though neither accident was my fault and neither accident cost them anything. Technically, there's no supposed to be able to do that, but practically speaking, they can do whatever they want. Insurance companies are the devil. The more you can keep them in the dark, the better off you are. Just keep calling and harassing the old lady's insurance company and the adjuster once one is assigned.

Wow... Geico sucks then. I've unfortunately been involved in a few incidents and fortunately was not found at fault and I've always contacted my agent first and gone through my insurance. I've not had my rates go up because of an accident that was not my fault.

In my experiences, by going through my insurance, they deal with chasing the other insurance company. But like I said before each insurance company is different and each state has their own laws on it.

And agree, insurance companys are the devil.

If you have a good agent, call them and get their option... you don't have to file anything.

If your insurance company is good, they will go to battle for you. I was a hit & run victim by an uninsured, unliscensed driver while our vehicle was parked unattended. A good sameritain got the plate of the offender & reported it to the police. My USAA insurance was able to get $$ from the uninsured driver 2 years after the accident to repay me my deductable.

The woman's insurance company finally took a look at my car yesterday. They estimated damages at $12,475 but do not think, at this point, it is a total loss. Fvckn a man, I would think any other insurance company would just total it. Metropolitan Collision is going to remove the sidewalls and let her insurance company inspect the integrity before they make their decision. At this point though I think I would rather them just total it. I mean, really over $12,000 of damages on a $22,000 car. Come on.

I was going to say that the insurance company would opt to repair unless you have at least $16k or $17k in damage. These days, insurance companies require closer to 75-80% before totaling the car out. Hopefully, they find some more repairs when they look closer. Make sure to let the adjuster know right up front that you will be seeking compensation for dimunition in value, which is recognized under Texas law. That could help push them over the edge if they're on the fence.

A friend of mine just had her 535i t-boned and her car is now keeping your's company over there at Metropolitan.

That is an excellent point, thank you! Hartford, her insurance provider, claims they consider cars a lost cause when the cost for repairs amounts to 72% of the car's estimated worth. So, I suppose I would need around $3,000 more in damages to be discovered in order for it to be considered totaled. If I didn't like that car so much I would go in there with a sledge hammer and beat the life out of it, but that scenario would just be wrong after all the good times together. However, now that I think about it, I do not recall anyone mentioning any damage to the suspension, which would easily add another 3Gs and I am sure it was damaged as I was changing lanes to avoid her when I hit her. I'll keep my fingers crossed for now.

As for Metropolitan, if it comes down to being repaired, I would not trust anyone else in town but them.

Also, I know most people on this forum are e9x guys, but if you know of anyone who would want some parts off my e46M, considering it does get totaled, let me know. I'm sure I could walk out of there with some souvenirs for charity. The mods, however, will either be transfered to a new car or sold.

Make sure they include 4 wheel alignment, check the steering components and see if the left rim is damaged ... can't see it from the pic... oh and you can't see the section where the left front fender meets the driver's side door.

And if it does get totaled, asked the insurance company how much it would cost to buy the totaled vehicle from them. Reason being is that I had a Wrangler a while back and it was totaled... Insurance gave me 5k for it and said I could buy it back from them as totaled for $400... Insurance companies don't want to have to deal with totaled cars so they may practically give it away... good luck again

Glad that you're not getting stuck with the old car, Kyle. Now, hopefully, you'll get a solid valuation from the adjuster. When do you think you'll get word on that front?

You probably haven't figured it out yet, but what direction do you think you might take in terms of a replacement?

Thanks. I should find out the valuation by the end of the day, but who knows with this company. I'm sure it will take longer.

As for the replacement, I have NO idea. I keep changing my mind. I thought I had narrowed it down to an '06 M3 ZCP or an '09 M3 6MT, but I recently threw an '08 RS4 into the mix. I'm so confused now.

Ok, so here's the deal:

I was offered $24,709.56 for my car. I had planned to buy my car back from this woman's insurance agency once they total it so I can part it out and resell it to a local guy here in Houston. However, I got off the phone with her company and apparently they will not sell it back to me unless I have a "buying license" in the state of Texas, whatever the fvck that means. Do you think it is a good idea to talk with my insurance agency and see if they can fight to get me more money for the lost car or should I leave them out of it completely? Either way they will eventually find out I was in an accident because her insurance company will have to contact mine.
