An extended warranty like they did for the HPFP issues on N54's would be appreciated and a great gesture to its M owners for their support and faith in the company.

Exactly. Surely voluntary recalls and extended warranties happen when they've stock still to shift. Not several years after the production line and tooling has moved onto something else

Ok Nik , on a serious note for this thread..Please guys let us think seriously only for 1 minute .
In case of a lawsuit I thought there was a date of the facts .Once the date of the facts are expired , and I thought in case of lawsuit the date limit is 5 years for the facts in Europe . The facts are our S65 bearings followed by complete engine failure . The facts are dating from 2007 and today we are in the year 2017 ! If I can count correctly , this means 10 + years ! In other words ...This case would be closed by BMW even before it is started because the date limit is expired by 5 + years . This is not the first thread about a class action for our S65 , this is actually the third thread in 2 years . We can better close this thread , same thing for the class action . So yeah Nik I agree , let us dream ..............

The E92 M3 with S65 is the best naturally aspirated combo, BMW ever made. I lusted after it since I first saw one. I finally was able to afford a very fine 2013 ZCP specimen of 06/13 production date, with 23,000 miles, one owner.
Do I worry about rod bearings, not at all. I love the car, the way it drives, the way it sounds and the fact that it's stupid fast To me is a dream car that finally became my reality, the rod bearing issue is overblown IMHO |

When it comes to class action, we will most likely get a postcard when a settlement has been reached, as it usually goes with class action suits and car manufacturers. A verdict will be, by comparison, very costly, as opposed to say extending warranty as part of settlement. I doubt a settlement will be in the form of a paltry $35 check though. We're talking about those stupid hoverboards.
If the settlement involves changing out the bearing, I believe it has to be approved as an acceptable fix before it can be settled. EDIT: oops sorry for bumping an old thread. I'm watching it closely as well however. |

I called the lawyers yesterday and had a fairly in depth discussion with them. Looks like they are in the discovery phase which should end after this summer. They have engineers they are consulting and are putting the case together. It should all shake out in the next year (estimate). I have posted the below before but just in case you missed it...give these guys a call and tell them about your experience!
There is no joining it btw, if you own an m3 and the bearing go you're automatically included. No idea what might come of it....extended warranty, the repair costs...nothing...who knows...
