The old lady waiting for deer to pass, do you guys feel she bears any responsibility for stopping? Was she stopping to let deer pass because she Is also fascinated with deer and want to watch them also?

I have experience deer trying to cross my pass all the time driving thru Poolesville MD. I slow down and lay on my horns until they are frightened away. I never come to a complete stop for deer.

The lady who stopped for deer holds no responsibility for the accident. The BMW was able to stop, so was the Accord. She just wasn't paying attention. End of story.

So the question remains... what will be replacing the AW M3?

Where did it say "old lady" ... as for never stopping mark my word one day the dear will find you. When it does I hope it be just a fender bender not the dear being airborne and going thru your windshield to take you out! I've seen it and once you saw it you change your way of thinking my friend.

Cup holders don't fit many of the cups/water bottles anyway.

glad your ok, I know that road very well & will be driving down it this Saturday I'll make sure to be extra careful....again glad your ok b/c the car can be replaced...

so what are you going to get...E90 or another E92?

Glad you are ok. The driver of the Saturn is pretty lucky you took the brunt of the collision. I don't think the Saturn would have faired quite as well.

The OP said older lady.

Either way, I usually stop or slow to a crawl if I see a deer. I have kept moving, laid on the horn, and multiple other things to scare deer before and it hasn't worked. Sometimes the deer still just stands there and stares at me. Sometimes you need to just stop and wait. A lot depends on what time of the year it is too, if you've managed to catch a male during mating season they become very... "ambitious" I would say

"Older lady", I kinda took that as an old lady. Come on Rolf, stop bustin my nuts! Also if you read my post I mentioned that I "slow down and lay on my horn" to scare them away. I did not in any shape or form advocate speeding up and taking your chances.

Anyways be it old ladies or some other fools that stop in the middle of the road extended period of time, usually to "Gawk at DEER" may have to be held partly responsible if that is what they were doing.

Every time I see deer on the side of the road I slow down and honk in the process, they run away. I do this because there are other drivers behind me or approaching from the other direction who has no idea that there are deer on the road. But for the old lady to just sit there like a bump on the log for a friggin herd to go by is just inviting danger for herself and others! Tell me you can't see any sense in this.

So your drivers door popped open during the impact and you got tossed out? Seems like BMW should have some type of saftey that would keep the door from coming open. Glad u are ok!!

It sounds like the OP dove out of the car intentionally during the collision. He mentioned a friend who was killed in an accident when he was pinned in a burning car, so I think the OP was trying to avoid that. The airbag charge made the OP think his car was on fire.

OP, thank your fairy godmother that you mostly walked away from this. Someone rear ending you @ 45mph+ when you are at a standstill could have easily killed or crippled you. Be glad you were in a 6mt...with your foot on the clutch/neutral and not on the break (as you would at a standstill with a DCT?). Think how much worse the impact would have been.

I had a woman merge into freeway traffic in front of my Nissan Titan while I was traveling @ 65mph...the woman did this @ 10mph (and that's being generous). I ended up side swiping someone trying to share a lane with them in order to avoid creaming her @ 50mph+. CHP actually ticketed the woman who merged @ that speed and bluntly told her she is lucky that I reacted the way I did.

...hopefully the accord has sufficient insurance, or you are going to discover how good your carrier is.

What a great car. Looks good, drives great and you can walk away from someone rear ending you at 45-60 mph without a major injury. Just one more reason to love the M3.
