Throttle Actuator Warranty

I have had CEL from Throttle actuator pop twice within few weeks and It looks like I apply for the 7yr/70k Emission Warranty since I have the car registered in New Jersey.. My question is... will they still work on my car under warranty when my car has test pipe installed along with ESS NA flash tune?

I cannot imagine either of those mods causing damage or accelerated wear to your actuators. There may be some fine print regarding what specific items are covered under this NJ emissions warranty. I have a feeling it may only cover things like a catalyst converter or ECM.

The emissions warranty is for stuff like the cats. The throttle actuators aren't considered an emissions device.

Actually, they are covered under the emissions warranty if you are in CA.

I just had mine replaced under warranty in CA for my 2011. Only Mods I have to emissions system is air intake and catback which were ok. However, BMW Service Manager who I have know for 20 years did say warranty would be void if I there was engine flash or throttle body type mods. Not sure what fine print is in NJ.

I have ESS NA flash that I will be flashing back to stock before taking into the dealer and I will probably be replacing the mid pipe back to OEM so that there is no question to be asked.

They are, as well as the ICV, the DME and a number of other components as well.

I will chime in on my experience as I have similar modifications. (sans) A tune.

Mines a 2011 and experienced limp mode numerous times. Im at 60K plus some and it seems to me most go out around that time from what I've read.

I too was concerned about modifications..

I cant speak for all dealers but I got recommended a service advisor from a reputable shop and he did not bat an eye. Says he takes modified cars all the time and with that being said I had no issues.

My advice if you haven't already tried, is to ask around at your local indy shop you go to or the forum based in your area if they know what SA's are easy to work with.
Get in touch with them and go from there with your issue.

Mine only took a day to replace.
Side note. I tried for him to replace both while in there but denied as BMW wont do a preventative measure fix. Kinda expected but didnt hurt to ask.

Went to the dealer today. It is covered under the California Emission Warranty even in NJ. He told me that as long as nothing was done to change the ECU/DME then I am fully covered for the throttle actuator replacement. I left my car and drove off with a loaner and my fingers are crossed.

I tried to get them to replace both as well, same story..they only replace the one that failed.

its not covered in every state. Only certain states. NY is not one of them.

Sorry to bump this thread, but I thought it would be useful as additional FYI.
The BMW M3 warranty booklet (from 2011) states the following:

*The California Emissions Control System Limited Warranty applies to all 2011 U.S.- specification BMW vehicles registered in California, Connecticut, Maine, Maryland, Massachusetts, New Jersey, New Mexico, Oregon, Pennsylvania, Rhode Island, Vermont or Washington."

And it includes coverage for TA's for 7 years / 70K miles.

A little OT, but I just got a thermostat replaced under the warranty since an Emissions warning light lit up. Saved me $1,500 for a thermostat!!

Proof is in the pudding, has anyone had their throttle actuators replaced under an extended warranty or not?

I just returned from a trip to NC from NYC. On the return with just over 60k on my 2010 E93, the throttle actuators acted up. Went to dealer in Va and after a few hrs they diagnosed bank 1 not functioning as well a brake fluid needed changing. Total cost $3700. They could not get parts for several days and I needed to get back to NYC anyway. Limp mode up and down NC and Va hills all the way back. Contacted BMW NA HQ in NJ. Explained the situation in an email that widespread coverage of this issue by BMW has been reported all over the country. Told them how I baby the car and how much I love driving it and owning it. All true. BMW NA called the following week (today) saying that they could offer a 10% discount on all work. Labor costs here in NYC are much higher than in NC, so the service here will be much more costly. I was hopeful that BMW would cover mine as they have for so many others. No such luck. With all the cars I've seen being covered for this issue, I had high hopes my car wold also be covered.
Has anyone had similar experiences in the NE market? I see a lot of coverage out west.

TA are $350 rebuilt or $550-$650 new each. Plus about 2 hours labor to change them. I am guessing the dealer was going to change both of them and was charging bmw list price that might be $770 each plus $200 and hour for 3 hours labor plus $300 for a brake flush, with the other $1200 being ridiculous profit. Glad you did not pay for it. Find a good independent shop.

The dealership where I was in NC said it’s at least a 7hr drive. BMW Manhattan still has the car in the shop for diagnosis as of 11:30 today. I’m hoping they do something for me. As common an issue as it is, BMW NA should do something to keep this from recurring. I realize it’s wear on gears etc, but this seems to be an excessive issue
