And why are you guys telling him he has to buy it?

You don't have to buy it... it's the dealer's responsibility to place an order or not, the risk is on them.
They could have simply said "No"

Also, iirc, the deposit is only returned if the car is sold. Meaning the dealer will keep his deposit until the deal is done.

I don't understand why you guys say you have to keep the car you order... even if the color combo is...unique to say the least

Amen. OP should buy the car if he can't find someone else to take it. This is exactly the reason BMW doesn't like to offer Individual in the US.

People can walk out on orders like this (speciality orders) in the US??

I would have certainly lost a big deposit... (probably enough for the dealer to swap out the seats themselves...)

The right thing to do is to take delivery of it. Just replace the fox red panels with something else (black alcantera?) and you've got a badass ride.

Yes we can. That's the main reason that Individual has always been difficult to get here. In most (all?) states you also recover any deposit that you made, even if the dealer call it "non refundable".

REminds me of the Phoenix Yellow over Imola E46 somebody got years ago. This is why some manufacturers ban certain color combos...

That color combo is just too far out there to order unless you know you can afford to swap the interior bits and then sell it. As much as I love to beat up dealers its hard to believe anyone could be that stupid. I'm thinking in one fashion or another they made sure to cover their ass.

Just my opinion but I disagree. It's a huge sticker and the whole concept just seems odd/ricey to me. I'm betting the 25 and younger crowd is where it is most popular. Certainly in SoCal it is probably much more common and accepted then here in the midwest.

i am prety sure you have seen some cars that were wrapped and you were not aware of ther wrap
think of it as coloured clear bra
i do see its advantages
you can change colours without the diminshed value of a colour change
your OEM paint is brand new when you finally unwrap
plus it protects against minor stone chips etc

yikes... if it was full FR it might be easier to find someone with black or speed cloth to do a swap, but that 2 tone doesn't sit well with me

Let's stop with the hyperbole and the just plain incorrect arguments, please... the dealer cannot sue for damages if there are no damages.

The car was "special" ordered by a dealer due to a potential customer request. In that order. So if the customer asked for a Pumpkin M3 with Mustard Novillo leather is up to the dealer to make the necessary financial agreements in case of this sale going nowhere as it ultimately did. Either the dealer impose some kind of penalty clause in the sale contract -if legal in that state- or simply refuse to order the abomination if the state does not allow any penalty clause.

This is very simple, but lately simple is no longer what it used to be. So what we have here is either a cold or a foolish calculation from the part of the dealer that may or may not affect the eventual sale of this car.

Regardless, the fact is that the customer apparently just walked away unscathed from the deal and most probably just because he/she was allowed to do such walk.

In this day and age I would think the OP would face some financial consquence if he chooses not to complete the deal..these custom orders usually involve a penalty.

And for guys discussing wraping the car..why would you go spend boat loads of money on custom paint color and then spend some more money to wrap it ..that makes no sense to me

Wrapping a car to protect the paint is basically saving the paint for the person you sell the car to in the future. I've never understood that argument. I'm ok with clear bras because they are clear...but other than that and you are just making your car look ugly so it looks better for the next owner.
