I just received this letter from the new attorney for BMW of Lincoln. I will let the letter speak for itself.
It appears that Ken will not be getting his M3 next week. |

Wow, so the dealership won't complete the transaction because they never worked with capital one before? Looks like we need to really organize on this. Scott, looks like it's time to press harder.
Ken, don't worry, they don't know that theirs more to financing then their crap dealership. Why does the dealer need to run a credit check. they don't need to. Why won't they just fax paperwork from the dealer to capital one? LAME! |

I am amazed that the dealer would go through so much trouble over what is likely no more than a $5000 loss on the sale (difference between the final auction price and the invoice price).
At this point, the OP could type retractions until his fingers go numb. The initial actions and this most recent letter do nothing more than confirm that this is a "dirty" dealership.

I wonder if the problem stems from Capital One Financing. Many dealers HATE and let me state HATE Cap One cuz they have to wait ages for the money to come through long after the car has left the dealership
So the question is, did the dealer KNOW you were funding this through pre- approved CAP ONE Financing via their on line application? Also very interesting they brought in new counsel. Did someone from VT corporate step in and put the kabosh on this? I wonder if Husker thinks it's better to not part with the car and let Ken rack up the legal bills. I guess they'd rather take more hits on their reputation have more eyes pass judgment on them than just let an over rated car get sold for a loss. I hate to say it, but this has been my impression as well based on the facts provided here alone as a casual observer without any more detail. The buyer was in the right and had the seller's pants down, face down and ass up, unwillingly bent over and the buyer ends up with limp dick. Why would anyone need to repetitively keep mentioning his or her ability to finance and not just pay the thing? 7 days. As is said, actions speak louder than words. Simply put, the buyer got himself in too deep, unintentionally, but then again was also fueled by the Internet. The power of the Internet. Used for good bringing to light bad practices and stupidity and yet basically turning this thing here into a shitstorm basically screwing this deal and the good the publicity has done. You guys shot yourself in the foot. Hopefully, the reputation of Tepper or any other innocent party isn't tarnished in this; he has done nothing but good. My respect. |
