Dealership wants to replace my engine with 1700 miles on the car. :( (kinda long)

Wow, I must say that I was skeptical that he'd actually get a new car. I'm anxious to hear the details of how he managed that.

Heck he could probably trade a dealer the allocation for one on the lot...I was at my dealership today and they had 5 M3's on the lot...to include 2 coupes, 1 vert, and 2 sedans! Seems like the housing market and economy are hurting alot of sales! Was talking to the sales manager CPO and he said he can't GIVE away the CPO X5's now. But he did say the diesel and hybrid or hydrogen X5 are around the corner with the diesel comming out next model year for 2010 which should help profitability again.

Seems to me that perhaps part of the agreement is that snows keeps the arrangement under wraps. Hey, I'd do the same if it got me a new car too. Either that or he is just waiting for everything to be set before giving an update.

Well, I may be in the same boat. Cars is at the dealership right now. SnowM3, if you can at least tell me where you took your car (dealer) so I can have my tech talk to the tech that looked at your car.

A note about the Lemon Law; I had a RR LR3 purchased back under the law but the vehicle has to be in service repair for a total (not necessarily consecutive) of 30 BUSINESS days. Then there is a calculation to subtract value based on mileage. I took that number and added some money and got the RR Sport. It was still a good deal as the resale on LR3s was not so good!

Well, an update. So here is what I have learned:

1. Follow your break in to the T. Regardless of whether you believe in the break in or not, if you have something wrong with your engine, the BMW rep can check to see what RPMs you hit (computers tracks it all). If they see you went over the recommended break in limits, then they could argue you caused the issue by not following the instructions.

2. Break in period does not end after the 1200 mile service. Notice your car does have another sticker that states you should continue the break in until 3000. It is not very specific but if you immediately start going into the 8400 range right after, that will count against you. Again, this only matters if there is something wrong with your engine and the BMW of NA rep gets involved.

3. Being loyal to a great dealership that is close to yuo is worth it even if you don't get basement pricing. My dealer (Steven's Creek BMW) has been great throughout this whole process exceeding my expectations in every way.

I think in this case the Lemon Law does not apply since the Manufacturer wants to dissect your engine for their own internal diagnostic and quality control needs.

A new car is in order since BMW NA/BMW Germany are already saying there is an engine defect and want your car.

Bottom end of your engine means crank and pistons...which is serious.

Maybe shoot for a 2009 M3 if you like the new tail styling and iDrive 2.0 with HD and hirez screen or a e93 Convertible. It is up to BMW NA to make things right.

Good luck....consider yourself lucky that BMW NA Corporate and Germany is on your side.

But there was not an acknoledgement that there was a flaw in the engine. The rep found I went over the 5500 limit once before 1200 miles and 2 times after. His conclusion was that this could have caused the damage. If it was not for my dealer being on my side and helping me work it out with BMW of NA, I may be in a completely different boat right now which is why I am so thankful I bought my car from my dealer.

I wonder if the dealer started the engine without oil in after draining the running in oil ?

Seems very strange that the noise started at the point the running in service was completed

It could be but the dealer staff is very good and I believe their shop foreman whom I have spoken to many times and is very maticulous may have done the service.

Mine has made the noise at least since the 1200 mile service. Folks can search for my old thread ("another clicking m3"), that I believe that also has the video of the noise (you can find other clicking videos from KnifeGun and Bills742).

I've spoken to my dealership and they had the roaming BMW engineer take a look at it, and have decided it has to do with the cats. For a bunch of reasons this doesn't seem to ring true. But the engineer said he'd heard the noise on other cars as well. And, as my SA points out, just cause they fly the engine to Germany doesn't necessarily imply bad bottom ends. But it is scary that so few have noticed this noise given how anal every seems to be regarding the smallest clang, tap, sizzle, click, or creak. So far, after another 500 miles, mine doesn't seem to be horrendously worse, though the engine does seem to shake more now than it used to.

The issue for swapping engines right now is the car is so new that not too many people have swaped engines. Even when the engine is sent as a whole, it is not always plug and play.
