Since there are probably no more new e9x m3, gap insurance at this stage is pretty pointless unless he got shafted buying the vehicle. The insurance payout will be market value which shouldn't be too bad if OP did his haggling work.

The days of "New Jersey Drive" are back in North Jersey unfortunately. Just saw a report about the Newark area on the news that said carjacking and auto theft are back in a BIG way again. Philly ain't no picnic either. 2 assholes carjacked a realtor last week and proceeded to run over an entire family selling items to help their church. The report stated that jacking and the type of theft the OP suffered are on the rise again because thieves are lazy and the auto theft deterrent systems are damn near undefeatable. Has nothing to do with luck and everything to do with poor choices.
doesn't matter. Car was stolen. Not his fault. It was on his property....so it was criminal trespass and grand theft. OP won't have an issue.

Exactly, leaving the key in the car and the garage open may not be viewed as reasonable precautions. If anything it is the opposite. If he tells the insurance company the real story they may legitimately give him a hard time.

This is just the kind of stuff insurance companies look for to reduce or withhold payouts.

Incorrect. Every insurance company/policy is different. There are often times language within insurance policies that talk about taking the precautions mentioned above, it is by no means cut and dry like you’re stating.

Leaving the garage door open is one thing, leaving the door open with the key inside the car, is something else. The OP needs to pull out his policy and start reading it.

It's an 08 e90, interlagos blue, tinted windows. NJ tag ZDP63Z, it should be in the areas of Newark, Irvington, East Orange, Orange according to the last time I tracked my EZ pass.

Most likely a crime of opportunity, someone walking by sees the car with the garage open. Decides to take it for a joy ride and abandon it afterwards.

As others have said they probably beat the living crap out of the engine and transmission. What to do is going to be difficult. If you sell it you will take a hit now that it is on record as being a stolen car.

Can you claim diminished value on your policy?
