the law is clear, but the issue I'm debating and you're avoiding is the implementation of the law. you said that the officer has discretion; therein lies the problem.
I'll make this easier for you. just answer this - if you were pulled over for doing 41mph over the speed limit, would you go to jail? the answer is that you most likely would not, and you can't deny that you would plead with the officer to not go to jail, and you'd feel cheated if the officer did send you to jail. I'm not saying you'd be wrong for feeling that way, but I do think it's completely hypocritical to have the holier-than-thou attitude you've had in this thread if you wouldn't willingly (i.e. without pleading for mercy or special treatment) go to jail for a jail-able offense. |

The trooper wrote the ticket for 105, and I still had to get a lawyer, pay $1700 ticket and do 100 hours of community service (which I did at my local parish) as part of the plea deal the lawyer made with the judge to prevent my license from being revoked. I still got 11 points for that infraction. If you are gonna speed at least invest in a V-1 or dont do it at all. Totally not worth it. Joe

It's been a few months since your post, but I hope things turned out well for you.
STRONGLY suggest an Escort 9500ci, which has radar detection as well as LIDAR (laser) detection and jamming. I have one in my 2011 E92 M3, and I can attest that it works well. Someone suggested that you have a second to slow down if you are hit with laser - I do not think that is accurate. LIDAR locks on quickly if they get a strong hit on your car (headlights are the primary target for the front, license plate for the rear). I generally stay within 10 mph of the speed limit, but on I-5 I've been known to go faster if the traffic is light. Have been hit by laser going 20+ mph over, and just get "the look" from the trooper trying to clock me as I pass by. |
