In CA a lemon is any car that's been to the dealer 3 or more times for the same problem without resolution or a cat that's been in the shop over 30 total days in a year. You're over both. Even if BMWNA doesn't want to do a buy-back, it's still a lemon. That's a fact they can't argue.
