This would actually be kinda legit since he'd be registering the device...but with that being said, do this at your own risk. Not only do you have to provide the info to get it registered, but if for some reason he messes up and you install iOS 5, you can't activate it because Apple will refuse non-dev activation.
I actually ran into an issue even though I thought I was signed up - for some reason my account was messed up and I couldn't activate it. To make matters worse, my phone ended up in a state where it wouldn't turn on - I had to go to the Apple store, and luckily they just restored it to a blank 4.3 without giving me any crap about being on 5. So again, do this at your own risk.
