our EU cars always start in D2 irrespective of GTS tune, only US models starts with manual mode for stock tune and D2 for GTS tune. so yes you'll need to check the current module flash to determine if it's stock or GTS.
Try doing it this way: You can display the part numbers of all installed modules (and lots of other useful information) with INPA...E90 -> Select E90 -> Functional Jobs -> <F2> Identification

Also is there a GS40 entry after "Select GS40"? Can't remember if it asked me for VIN, if not I must've selected something else from the list after "Select GS40".
