The OEM gasket is slightly smaller than the ports on the headers, assuming the exhaust ports on the head are the same size as the gaskets i don't see this being a problem so I'll probably still use the oem gaskets if that is the case when i remove the headers:

the hardware that comes with these kind of exhausts are terrible.
judging by the photo that you have taken the OEM gasket is just fine. Even if its a mm undersized it shouldn't be a big problem. had the same kind of experience back when the e46 m3 headers on ebay were a hot item.
