We can actually. The problem is finding a U.S. dealer who knows how to get an M3 under the Individual program. Most don't even know that it's possible. Of course you have to pay more: the paint is $5000 (over 30+ colors should be available) and the interior is supposedly $4100 (should be at least 4 upholstery colors available).
