I know I would want a new car too. But its also one of those things that could cost you a lot of time and money. Tough call. Remember, people here have already had their M-DCT transmissions replaced because the service dept screwed up. Could they also have gotten new cars? Maybe so, but not without a lot of headache.

At the very least, I would insist upon some compensation for the car being in the shop for a month or whatever amount of time. Maybe some addtional compensation beyond that, and also, since BMW USA is involved, maybe an M loaner of some kind from their fleet.

I'd have to agree...fighting for a new car is probably going to be very time consuming, stressful and potentially expensive if you get a lawyer involved. I certainly approach BMWNA about them making it right by giving you a new car!! Also, be aware you need to deal with BMWNA directly on this - the dealership is not going to be able to make that kind of decision anyway - without BMWNA's permission - as they will be the one's footing the bill. Unless you can somehow prove the engine is fried due to the dealers recent service activity? The fact that BMW jumped in so quick makes me think there may be a few other engine failure cases lurking out there and they are trying to pinpoint why they are failing....I'd make sure you have BMWNA's attention and commitment to ship a new engine ASAP, and some sort of concession for your trouble - extended warrantly, etc. I wish you luck as this is a pain with a new (and very expensive) car and can ruin your entire ownership experience - if you let it. Stay involved and deal directly with BMWNA as much as you can...good news is that you already have their attention!! I just dropped mine off for the 1200 mile service and to have them fix a "clanking" noise that I get on cold start up. Sounds like the engine accessory belt is slapping something right when the engine starts up...not very encouraging to hear - but once it starts it sounds fine and will not make the noise again until it has sat overnight...makes me think (hope) it's not internal engine failure - but something with an accessory or the belt/pully system.
