So turns out everyone was correct in this argument in their own way.
I called the BMW of San Francisco, and spoke with Lucas, their Sr. Service Advisor.
He stated that a major change in this matter took place about a year ago. He said that historically Dinan parts did NOT breach the BMW warranty, but the dealers were getting so many new cars coming in with issues, that BMW decided to withdraw from their relationship.
He said that people with Dinan parts tended to typically push their cars harder and abusing the warranty. And when Dinan only covered the parts, not the labor, this created problems.
Now, if a car comes into the shop with Dinan software it is automatically flagged by their computer in their system. And if an issue evolves which is related to performance software, any parts related to this software won't be covered under BMW manufacturer warranty.
And further, if a tech sees a Dinan part (or any other performance mod/part) installed on the car, they will manually flag that car into their system, so any problem arising related to that particular part, will now not being covered under BMW's warranty.
I haven't spoken to Dinan yet, so I don't know whether they will cover this portion of the warranty which is now voided once their parts go on, but we'll see.
Additionally what sux for us, is that BMW dealers will no longer upload Dinan software onto our ECUs.
I'll follow up with an update once I get a chance to speak to Dinan about this.
