In 2005, my ED e90 330i car needed a new hood, front and rear bumper, and both driver's side doors, after cars got loose in rough seas... It happens. Sucks, but it happens.

I already took delivery and owned the car in Munich... ED car, you own it. So, yep, I accepted it. FWIW, it never showed up on carfax.

This happened in late 2007/early 2008. Many of the damaged cars were repaired and sold as new according to the stories I read at the time.

Interesting, so that is one drawback on ED that I bet many people don't realize (albeit an extremely rare occurrence).

Yeah, I believe this happened shortly after my 2008 328i was delivered if recollection serves. May've been shortly before as well. All I know is it was around that time and my car wasn't on that particular boat.

I wouldn't call that a drawback at all or even rare. Any car damaged on the way overseas are fixed and sold as new. I'm sure there are a lot of people on this board who's car are smashed like the ones in the pic above and have no clue. And dealers almost never have a clue that this happens either, so don't bother asking them.

I see. The way you stated though was because you ED'd the car, no matter what happens in transit (i.e. major body damage), you have to accept it with the repairs they make.

The difference I was pointing to was that if one wasn't an ED, and by some miracle BMW NA was honest about this happening to your specific order (non ED), you could opt to say you don't want the car.

I guess the final question would be, is there a legal stipulation in your ED documentation that says something similar to the above upon acceptance of ED in Germany?

Like I said, it was early (January) 2008. The MV Courage tipped over in port at Jersey City. Quick story:

At BMW's port prep center in New Jersey, the body shop is huge and they are constantly fixing cars damaged in transit to the U.S.

If you buy one that has been damaged and fixed off the lot, you'll never know.

If you special order one, the dealer will tell you why your delivery is taking longer than usual (if it's a good dealer), but you don't get a free option to back out of the contract. It's like getting out of any other BMW order contract - you just have to work something out with the dealer.

I never kid myself about a new BMW being "perfect." Some of these cars come off the assembly line, and when they try to start them for the motor test, the engine won't even fire up. They don't point this out on the factory tours, but at the end of the line, there is always a repair area with several lifts, all full of cars getting worked on by mechanics to fix failures that show up during the dyno test.

This happened to someone who just ordered a new Audi RS5 2 months ago. It was a special order and got damaged while shipped. He contacted Audi NA and the president himself called him to apologize and to offer his money back or to expedite a new order. That guy is getting a new RS5 which should be done in 2 months instead of 4. I guess BMW and Audi are different when it comes to deal with customers..
