The EPA wants to make it illegal to modify your car for racing...

Posting this here because of the direct effect on the tracking community.

You knew this was coming....

I hope more racing associations, groups, and sponsors join SEMA in fighting this.

Thanks for posting their "clarification", redpriest.

Happy that SEMA's actions have already created a stir w/ the EPA.

The bad news is that this EPA "clarification" actually confirms our concern. Now they say that only dirt bikes or snowmobiles are considered "nonroad" (off-road) vehicles and are the only type of vehicle allowed to modify emissions control systems for competition, cars and light trucks cannot (and never did apparently) according to this clarification...

"Off-Road Use Only", a label used by the aftermarket on non smog legal equipment, no longer pertains to cars and light trucks now according to the EPA...?!

Ridiculous!

I think this ruins Murican innovation in the long run.

Look at all the enthusiast development with 4cylinder and 6cylinder turbo's... now the manufacturers are using the same ingenuity to make more power out of factory cars while using less fuel and cleaner emissions.

A good example is the water injection system that you can get in the F80 M3... essentially that is a factory installed water meth system.

If I'm reading this correct... I wouldn't be able to (if I wanted) swap the drive train and emissions systems out of a Miata and replace it with clean electric power... because according to this technically I am tampering with the emissions systems.

For those too lazy to read the whole article, here's the relevant new statement from EPA:

"This clarification does not affect EPA's enforcement authority. It is still illegal to tamper with or defeat the emission control systems of motor vehicles. In the course of selecting cases for enforcement, the EPA has and will continue to consider whether the tampered vehicle is used exclusively for competition. The EPA remains primarily concerned with cases where the tampered vehicle is used on public roads, and more specifically with aftermarket manufacturers who sell devices that defeat emission control systems on vehicles used on public roads."

It has ALWAYS been illegal to operate a car on the street that has the emissions or emission controls related parts tampered. Cars that don't pass smog CAN NOT be operated on the street.

This changes nothing. If you remove your cat and ran straight pipes and you trailer the car to and from the track? Legal. If you remove your cat and ran straight pipes and you drive from your home to the track? Illegal.

The only difference is now EPA will enforce it. Aftermarket manufacturers can no longer provide headers and catless exhausts under the pretense of "for off-road/race use only" but sell it for all the masses that choose to run catless on the street.

They've merely removed that pretense. That's all. This is something that the Automotive Aftermarket has been bracing for for a LONG, long time.
