Tint ticket -- Should I fight?

Last night around 2am I was driving back home from my friends place and I saw a guy got pulled over. After about 3 mins I saw the cop light in my mirror ( I think it's the same cop)

He told me that I was pulled over because I had my windows tinted (F:35% R:20%, I got this when I was in WA), he asked for my license, insurance and registration. Then questioned why I don't get my CA license..

He came back with a ticket saying:

14600(a)VC Failure to notify DMW of address change within 10 days.
26708(a)(1)VC Tinted window

I got 2 questions here:
1. Is 26708(a)(1)VC a fix-it ticket? I did some research and it seems that with 26708 I'll have to remove all window tinting. Though when I was pulled over he didn't measure the tint of my car.

2.Based on the definition of 14600, I can notify DMV the address change and thus reduce the fine to $10 or so, I think this doesn't have anything to do with my WA drive license, I can just notify DMV that my address has changed and pay a little, am I right?

Thanks everyone,

j

Edited:
I am in NorCal, I was driving northbound on San Antonio Ave. From Los Altos, CA to Palo Alto, CA. I got pulled in Mountain View, CA and the cop is Los Altos Police Dept.

In California a cop can give you a ticket for any amount of tint in the front windows. You just need to get it signed off by a sheriff (or if you know a sheriff ) and pay the $25 fine at the courthouse.

I think you can still pay the fine without removing the front tints but it will be pretty hefty.

Next time (if there is a next time), just say you work over here and live over there, etc. Worked for me.

Can I put after-market tinting on the windows of my vehicle?

The main requirements for legal window tinting in California are:

1.The windshield and front driver's side and passenger's side windows cannot receive any aftermarket tinting.
2.If the rear window of a vehicle is tinted, the vehicle must have outside rearview mirrors on both sides.

The law prohibits any person from driving any motor vehicle with any object or material placed, displayed, installed, affixed, or applied upon the windshield or side or rear windows, with certain limited exceptions.

However, legislation signed into law effective January 1, 1999, exempts from the above prohibition specified clear, colorless, and transparent material that is installed, affixed, or applied to the front driver and passenger side windows for the specific purpose of reducing ultraviolet rays. If, as, or when this material becomes torn, bubbled or otherwise worn, it must be removed or replaced.

Edit: Play at your own risk in California

You are lucky, I had 5% once, and got stopped repeatedly, one time at gun point.

Now I just roll without tints. I want people to see me in this car

Thanks everyone and ya I think I will just pay without remove the from tint. Cuz I know I will put it on again even after removing hence the difference should be able the justify the cost to remove+reinstall and the hassle.

That's what I did. I figured the cost and time taken to remove the tint, get the ticket signed off, and put it back on would be very close to paying the higher fee.

tint in the front is not allowed. Just pay for the ticket instead of removing and tint it again

Last time I checked it was $10 for the city marshal to sign off and $10 for the court fee. I had 10+ tickets for tint in my teen days. lol

Not sure about the marshal fee but now the courts charge $25 per infraction.

So if you have a tint and license plate ticket signed off, they're gonna charge you $50 I've gotten about 5 tint tickets so far smh

Quick update: it's been a month and I didn't receive any courtesy notice from the court and the appearance date on my citation is on/by 7/2 (which is next Tuesday). I suppose for any CA ticket you would receive a courtesy notice? Correct me if I am wrong. Anyway I just got my CA license (C+M1) so I will go to the clerk's office to pay the fine on Monday.

Thanks again everyone for the inputs.

A courtesy notice is simply a reminder only. L.E. agencies including court houses are not obligated to send you a 2nd notice via mail. You have your "promise to appear" date (1st notice) on the ticket that you signed.

If you have a residence in Washington with legal papers from the state verifying tint is legal there and if you are just visiting then that ticket can and will be thrown out. Even if you are there temporarily.

Also, you do not need to have a California license unless you plan on having California as your home of residence or are making it a permanent place of living.

The CHP tried to pull that shit with me in San Diego California last year in 2012 when I was on vacation. I have 35% front and 20% rear. They asked the same things.

#1) I told them that I am on vacation and leaving for Maine in 20 days.
#2) I had Oregon State Police verification stating the 35% was legal in the state of Oregon and on public highways there which I am a resident of.
#3) Home residence of Oregon.

They had no grounds to stand and I told him I would go to court and have before and he would be wasting his time and the judges time.

He gave me a warning and said that other Police may hassle me before I leave. They didn't and no ticket.

I know everyones case is different but if you are from out of state you can fight it.

Do you have CA plates? I assume most cops will warn you of your tint if you have out of state plates. Still is probable cause to pull you over so if you're drunk or just robbed a bank don't cry if you end up in jail. As of your change of address if you're living in CA pay the fee to change it over. You know your situation. Live here change your address of record and pay the fee, if you don't then prove to the court and have it dropped. Simple stuff.

Having tint is still probable cause to pull you over. I'm sure you told the cop he had no grounds for enforcement and he was wasting everyone's time. I've heard cops get scared when people threaten court and even sue.

True and my out of state plates rang the bell. lol I don't think they get scared, some are understanding. It wasn't like I demanded what I told him. I asked if I could explain my situation and he said go ahead.

Usually out of state folks get a break with equipment violations. Moving violations not so much.

Unless you are NOT a CA resident... there is nothing to fight. In CA, you are not allowed to have any tint on front driver's & passenger side windows.

1. Remove tint;
2. Have the car inspected and ticket signed off;
3. Pay processing fees, etc.; and
4. Have new tint installed.
