Free service after warranty if you already told them about a problem?

I have taken my M3 in for service a few times and EVERY time I complain of the seatbelt butlers not extending. First the passenger side went sporadic. Now the drivers side never extends on a cold start. 3-4 appointments they have told me it looks fine and they couldn't reproduce the problem. So considering I have brought this up many times and they haven't been able to address it, if they ever go completely kaput is there any chance they'd make the repair for free out of warranty? My friend mentioned this possibility to me and I'm wondering if it's true.

If you complained about the problem, before you were out of warranty they might fix under goodwill. You can't be to far out of warranty by mileage or time.

I'd try a different dealer before the warranty expires. It's hard to say if they will or will not fix it for free especially after warranty is done. I would avoid taking the risk.

I'm officially out of warranty, but they're fixing my AC evaporator and broken iDrive knob today - both were caught while I was still under warranty, however.

This is probably your only hope for a problem that can't be readily reproduced.

Since its sporadic, you should video tape it and see if you can capture it.
