Diff literally fell off car when driving.... (BMW denined warranty, total BS)

Hello,

This thread is to show BMW Canada's lack of being truthful and justified.

I bought an 2008 e92 m3 from a BMW dealership on Montreal, Quebec in April 2012. Car had 36000km (25k miles) seemed in good shape. A few weeks went by and I noticed some noises from my diff, I lifted the car and noticed the subframe/diff were rusted (see pic below). I complained to the dealer about this issue, they took in the car said the rust was normal and that they would replace it if anything ever happened. They also replaced the fluid in the diff (they also claimed everything was normal and that m3's make noises from the diff, tranny, and body). The noise was less but there was still a looseness from the diff, although at times I'd hear a bang in the back of the car which again the dealer claimed was normal (bang as in a gunshoot but quieter).

Fast foward 2 months and while pulling away from a stop (not launching or dropping the clutch, just a spirited drive) I hear the loudest bang I've ever heard, I continued driving for a few feet until I felt something was seriously wrong, I look under and theres my diff on the ground. I get the car towed to the dealer (it was a friday so I had to wait til monday to speak with my Tech Advisor). The dealer inspects the car and tells me the bolts broke, I then inspect the car at the dealer and see that the actual housing is cracked (the back part, the fins, that bolts to the frame). The techanical manager then tells me oh that looks broken, the bolts are 100% not broken.

Tech Advisor then sends pictures to BMW Canada, BMW Canada says they want to pull the log of the computer. They pull the log which states I hit redline 2000km (1250miles) before the diff broke. BMW Canada then says your client redlined his car so we aren't covering this broken diff. Dealer doesn't really do anything, so they send me a $10,900 bill and say you have to fix the car and my warranty is void on the diff. I then say how can a redline break a diff, the report they showed says I hit redline in first gear going 20km/h. I also brought car in to BMW for service after they said I redlined the car and they said everything was good, so how could it break 2000km later. It's an M3 you should be able to hit redline and not worry about breaking something, I allegedly hit redline once in the time I owned the car.

I also called BMW Canada, they told me they don't deal with customers. I spoke to a lawyer who told me basically we can fight it but ultimately I have to pay for the damages right now or wait until we win/lose the court case in 18 months.

In the end, I feel like I paid an extra $10,000 for a car on warranty and now my damage which should be covered under warranty is going to cost $10,000. BMW warranty is a bunch a BS, the fact that the headquarters will not talk with customers is outright wrong. They also never told me the car was repainted until after I bought the car, and how can a car with 22500 miles have a rusted subframe.

That sucks to hear. Try talking to another dealer because this makes no sense.

The car being painted is another issue in which you have no recourse since you already took possession of the car.

Lastly, you live in a place where it snows. This means that there is likely salt used on the roads. Therefore it is quite likely that the rust shown could have occurred with prolonged exposure.

Yea that's a good idea but the HQ already past the judgement not sure if it'll work either way I'll make a call or two and see what happens.

The roads are salted but the car was supposedly only driven in summer time.

You can always ask the dealer where it's stated that hitting redline in your car voids parts on the car.

Their key finding is he hit redline going 20 km/h, which means it was during a massive burnout, if true. Probably would qualify as "abuse."

Yes, but shouldn't cause a diff housing to break 2000km later.

It could also mean the person was in neutral and missed 2nd gear, it could also mean the person was revving the engine with the clutch in or in neutral... There's a few variables in a huge equation with many unknowns that could lead to many different answers.

BS. Then why does BMW include a launch control feature on this car?

OP...a diff doesn't cost $10K to fix. An independent shop would do this for a fraction of the cost. Did you authorize them to fix it knowing it wouldn't be covered under warranty? Of course not. Demand the car back (make them remove their $10K diff) and if they don't comply, go to the dealer on a busy day and call the police. The dealer will be sh*tting their pants with teh police arrive.

I have run a sales dept at a dealer before (not bmw) and I would have had service eat the repair and duke it out with the factory and leave the customer out of it.

Sorry to see this OP.

Regarding what you said about the dealer saying the car doesn't have paintwork...


When dealers sell their pre-owned stuff, it's usually clean. Most cars have had their bumpers painted, (that's basic, it's nothing major as bumpers take the most abuse on a vehicle) You didn't disclose what was painted on your car, but it's important that people understand dealers will say what they have to, to get a sale.

I was at a dealership with my dad about a year ago, and we were looking at a pre-owned x5. It was white, and in the showroom under the lights. The salesman kept telling us how clean it was, free of paintwork etc.. And as I was inspecting I found a huge repair spot on the hood. I then asked him what it was, and of course, like a good salesman he said it would "buff out". A regular person would have believe this, but being that my father has a body shop and I work there, it was obvious. The lie was so blatant and disgusting my dad and I just left and have NEVER went back there.


Sorry for the rant, but just a heads up to everyone...

Do you drive in the salt brine & snow like those who drive their M's in a Canadian winter?Looks pretty normal for a 4 year old winter driven car in Eastern Canada.

To the comment above about OP doing "burnouts"...

When I was a piss pot I had a 1993 Firebird Formula with way too much power and a stick. With its 10 bolt diff (same as a chevy astro van!) I autcrossed the crap out of that shit box. Every launch I wasted the victoracers on the rear needlessly, and had a blast. But despite the high miles- over 100k and running the hell ouf of the car the rear end never fell out.

This is simply not right on the manufacturer, the warranty company(I dont know who underwrite bmw cpo) and the dealer. Take care of this guy if you ever expect him to buy another car from you!

Yea, I can't believe they aren't atleast doing something... The so called "abuse" happened 2000km before my actually diff fell out of the car...

I also own a 1990 Nissan GTR running 600hp and I've driven many times on the drag strip, and circuit, the diff never broke (nothing in the drivetrain besides the clutch actually broke). The diff, axles, driveshaft, are all stock.... Why did a 2008 m3 diff fall out of the car? The m3 should be able to handle its stock power even under abuse, there are limits to abuse I mean bouncing off the rev limiter, clutch kicking, and wheelhop will eventually break things but for an m3 should be able to handle pretty much anything. One of my buddies has an e46 m3, it has been a dedicated track car, is abused almost every day it is driven, and is pretty much stock, it has never had a major issue like this. My e92 was never really abused as such, I've never done a burnout, the only thing I've done is gone full gas from a stop but not a launch with a clutch drop... and no launch control either.

I am truly appalled at the BMW dealerships real lack of willingness to resolve the issue with BMW Canada. BMW Canada denined the claim, should it stop their? I bought the car from the BMW dealer thinking that because I bought it from them they would essentially take care of any of my issues and try to keep me as a customer.

The dealership flat out lied to me multiple times... BTW the dealership also told me the car was never winter driven, with a rusted subframe as such I believe it definitely was. Shame on me for not looking under the car before I bought the car but I thought buying from a BMW dealership with a certified warranty from BMW Canada annulled any reason to actually look under.

Truly disappointed with BMW and the dealership.
