Also, going to the police will be of little help. Once OP tells them that he put down 20k in cash that he never withdrew from a bank nor did he receive a receipt, his credibility is gone.

Much better to pursue it civilly where you have a lower burden of proof and don't have to prove criminal intent.

I talked to the guys at Valencia and they knew about this right away. This is what they told me..

The finance guy said that one of their guys was doing the paperwork and everything and it was his 1st day on the job. He said he completely forgot to get the down payment so he called him the next day and he told him on the phone that he would come the next day to pay. But he didn't go, so they called him again and he said he signed all the papers and he payed and tried to get away with not paying 20k. So they said their going to reposes the vehicle, so he drove down to the dealership and called the cops.

The cops asked him where the receipt was and if there is any proof you took 20k out of the bank. He said no, so the cops called the towing company and took the car. They said that he tried to get away with not paying the 20k, but was co-operative on the phone when they told him they never received it and told them he was going to drop it off the next day.

In my opinion.. what happened was he left with the car without paying down payment, tried to get away with it, failed. Got his vehicle repossessed and now its on his record so hes a little mad it failed.

FYI: I just bought my new e93 alpine white m3

Finally done with this stupid ordeal. just fyi the dumb-a$$ that don't know crap should just keep their mouth shut. btw (NasHh) of course they told you that you're a potential customer. duh... the guy was a manager not some dumb ass newbie...n e way... had to get a lawyer and finally got my money back and sorry can't say more cause sign some stupid paper... but i thought my fellow member deserve a update. so just take my advise don't go there...save yourself a whole lot of trouble and money.

I've personally never had an issue with Valencia BMW.

Purchased 2 cars from there in 2 years, each only a couple hundred over invoice (with no haggling)

This was interesting. I actually bought my car from Schaeffer BMW. It is in Wilmington, NC. They filmed the episodes of East Bound and Down there. They have been great to deal with. Still haven't seen Ashley Shaeffer.

I m a sales manager for Nissan. Whenever you pay cash, there is another manager as witness count cash with customers. Yes there had been times that finance forget to collect down payment and usually clients bring it back. There's an extra receipt given at end of transaction. I think someone tried to take advantage of finance person stupid mistake because finance person usually make good chunk of money to risk stealing 20k. He might have won law suit but karma is around the corner.
