can a car be CPO'ed with a aftermarket exhaust?

My lease is ending and dealer offered to CPO the car before I buy it out, my question is will it still pass the CPO inspection with a aftermarket exhaust? Thanks in advance for any help.

In this case yes, the dealer is willing to overlook the exhaust since you are buying your own car out and they are making money on the certification. I would highly doubt that a dealer would CPO a car with any aftermarket part to put up for sale to the public.

The CPO specifically states that aftermarket parts are not acceptable. Though I think there may be slight exceptions. The dealer has no issue overlooking a few things though.

They don't mind making money off of CPO'ing your car, and then denying you warranty later on for aftermarket parts. It's like free money for them.

I bought my 2003 M3 vert in 2008 from a BMW dealership as a Certified Series vehicle. When I bought it, it had an aftermarket exhaust. It never affected the remaining CS warranty nor did it prevent the car from being a CS car.

I don't think (legal) tint would be a problem anywhere, but mechanical parts I'd imagine so. But not even the stock warranty would warrant an aftermarket exhaust (or related problem) so what's the big deal?
