Frame Damage

I am selling my car, but it has frame damage. If I disclose this information, am I still liable in any way after I sell the car? I plan on having the frame damage in writing in the bill of sale.

once you disclose it, you are fine.


But than again, if it has a clean title, and you sell it.. Then the person finds out it has frame... I wonder how that works?

Because it is used, so anything is possible. hmm

Well I definitely plan on disclosing it to people, but I don't know if I have to have a thorough inspection for the new buyer, or if I am liable for their safety. If anyone knows please chime in. I would greatly appreciate it.

the buyer can inspect if they choose to.

They can request whatever they feel to make themselves feel safe about the purchase.

So if I am understanding you correctly, it is 100% on the buyer to do all necessary check ups? The appraiser at carmax said I could get sued for selling a car with frame damage if the buyer got into an accident.. I guess it's my fault for believing a word he said..

yes, as far as I understand.

I'm looking at it like this, if i buy a used car.. it is my responsibility to do all checks on that vehicle. I do not see how you (the buyer) could be liable for anything. (Unless you choose not to disclose certain info) such as accurate mileage, salvaged title etc.

Just to update.. I spoke to the appraiser over the phone, and he explained that there was no problem with the car... it's just that carmax lists the car with frame damage if there was any work done on the frame. Thanks for the help IFX

If you know that there is a big issue with the car and you don't disclose it, you can be held liable
but if you disclose it, then you shouldn't be liable

if you want to make it more concrete, you can have a contract written up that you disclosed all known issues and the both you and the buyer sign it. Not sure if it'll do much but it's something
