Car totaled in Arizona..what should i do?

I was hit in AZ car totaled ... her fault and she had no license or insurance.?HELP PLEASE !! My insurance paid me out minus the deductable (of course), she since then has paid me 500 to cover the deductable, but now I have medical bills that need to be paid. Should she have paid the deductable and is she responsible for my medical bills too. Oh yeah the car she was driving belongs to someone else too.

I think this is the point where you get a lawyer involved.

Sorry though: I don't have any recommendations.

Your insurance shouldve covered your medical expenses! But it sounds like you already signed off the paper work and closed the claim!

Go get a lawyer......NOW!

This is true, assuming you had Uninsured Motorist Bodily Injury coverage.

I know you're not the one at fault, but this article provides interesting info since you were hit by someone who was uninsured and driving someone else's car: http://www.insure.com/car-insurance/...ashes-car.html

Basically if the info in that page is accurate, you can actually get restitution from the insurance of the car's owner even though he/she wasn't driving.

I didn't even know Uninsured Motorist coverage existed until I moved to TX.

Should be a requirement for everyone in the Southwest forums

I think it is a requirement, but I'm not sure. Uninsured Motorist Property Damage isn't, but that's because having comprehensive coverage on your car covers that scenario anyway. I came from California where there are also lots of (illegally) uninsured drivers. I think it should be a must everywhere, especially since it also covers hit-and-run accidents as well as drivers who are UNDERinsured, which can help if somebody carrying the minimum coverage causes you and your passengers a lot of damage.

You can claim from your own AZ car insurance company and then they can go after her to claim. This is the point to get your own car insurance company involved.
