Pulled over for loud exhaust (question)

I got pulled over by CHP on the 91 east bound. I was advised by the officer that having a modified exhaust from an 08 car or newer is illegal, and if emissions is tampered, can result in a misdemeanor offense!!???
Maximum sentence of a year in jail.

Is he BSing or is this something that is true?

He ended up letting me go, however i now feel uncomfortable with my exhaust set up as i'm full straightpiped. (i don't drive like an ass). FYI i was pulled over for going 75mph... LOL

Anyway, if anyone knows if he was bsing or not please let me know, i'm not trying to start a comment war but input would be awesome. thanks

waiting for someone to give his opinion....my exhaust is not that loud, but its a straight pipe too with terrible smell.....when I see a cop I try to drive as smooth as possible haha

He wasn't completely BSing you. Here is some food for thought... Driving past a construction cone carries a maximum of 90 days in jail and a maximum $1000 fine. There are ways to skirt laws and yes you CAN do jail time, but is it likely, absolutely not. Those laws are in place for lets say, an exhaust shop illegally modifying their cars and tampering with emission systems. Even intake is "technically" illegal in CA. Are you going to get a ticket for it, highly unlikely. The large majority of cops I have talked to always tell me that newer cars driving responsibly that aren't insanely loud won't get ticketed unless you're doing something else illegal.

The best advice I can give you, is to let the officer tell you why he pulled you over, and don't be confrontational about "laws". Because in the end of the day, he can ticket you and impound your car if he feels like it since technically your mods are illegal. If you're polite and tell him you thought that since your car passed emissions it was legal to have exhaust, he'll say something condescending and let you drive off without a ticket. The state of California can't fully afford to issue $127 fix-it tickets (I think that amount is wrong). When their cost to take it to court is around $47. It's just not worth their time on the docket.

I hope my unprofessional viewpoints have some validity to ya!

Actually that helps a lot! And yes i've met quite a few police officers, and being polite usually lets you off with a warning (unless motorcycle cop). My father is a retired police officer and he told me that they actually have a (quota) that they have to reach with tickets a month.. Patrol cars (non chp) will rarely pull you over to ticket you unless they are unfortunately really bored or the person does something totally illegal in front of them. I asked my dad about this situation and he couldn't give me a definite answer as he says laws may have changed in the past 5 years.

Anywho thank you for the info!

Yeah no problem man! And yeah even when you're "right" regarding a law, if you're condescending to the officer you never get a friendly response. I know me car doesn't pass emissions, but since I obviously have current registration and if I say it does, they'll buy it (or at the very least, not waste any more of their time "investigating").

Good to see the California cops concentrating on real criminals like you instead of wasting time on petty issues like immigration, drug trafficking, and gang crime.

Saw a piece on 60 Minutes on how the U.S. is 20 years behind China on the development of rare earth minerals (google it) because California got it's panties in a bunch and closed a mining complex over environmental concerns. Being from NY I'm all too aware of how liberals run things. Carry on.
