Parking brake doesn't hold

no no, BMW ebrake sucks big time. I've complained to the Service Writer when I used to own the E36 M3, and my ZHP.
I must've messed around with the ebrake on my E36 M3 like over 10 times; trying to adjust it. Failed every single time.
My old MKIII jetta with 250k miles on it had better ebrake than my E46 330i ZHP. Never used to leave it in gear.

The dealer should repair it with no issues since you're still under warranty.

It's a good practice however to always leave your car in gear when you park it.

Yep, I'm started leaving it in 4th gear so that if I forget and let the clutch out after starting the car it will stall instead of running through my garage door. In 1st it will jump a good ways.

I have transmission problems on the 6MT with 17,000 miles (I've only got 2,000 on it since I purchased it) I'm afraid of taking it in to this new dealer since I purchased it from another BMW dealer 215 miles away. I'm worried that if I bring up a transmission problem and a e-brake problem they're going to red flag me as an abuser and deny warranty service. I'm more than just a little worried about it. I'm guessing the 6MT is somewhere around 7 to 10K to replace.

Nonsense, take it in to any dealer you want. It's covered under warranty. If they deny to repair it call BMW North America and tear them a new one.

Dealer must honor warranty contracts otherwise they get in big trouble.

Absolutely the dealer will cover this transmission. Hell, they'll be reimbursed plus labor charges. The mother's milk of dealers everywhere. Maybe next time, if they give you a good deal and repair this car correctly, you'll think about buying your next car from them. They're auditioning for you. Now go break they're balls.

Seems like a working parking brake is something pretty serious and should be fixed right no matter how many dealers need to look at it

It's nice the BMW puts that information in the manual, but did they put it in the "absolutely redundant and unnecessary to say" section? You should always try to pack a manual transmission in gear. There is no "park" feature on the manual transmission, so the ONLY thing keeping your car from rolling is the Ebrake, transmission resistance and hopefully correct parking techniques (tires turned properly for grade).

For those stating that they leave it in fourth in case they forget it's in gear and pop the clutch, you should seriously get n the habit of running your transmission through neutral once or twice on start up. Audi got a bad reputation in the 80s/90s from bad driver habits.

This sounds like the fix could just be a simple adjustment to the ebrake.
