08 M3

Did you pose this question on the other applicable forums otherwise I hope you do realize that you are going to get the opinion of mostly E9x M3 lovers. Also, without details on individual respective cars to compare this isn't very meaningful research or advice.

Go for the M3. I am a current M5 driver, have an M3 on order to take it place for now. The 06 M5 is an unbelievable car, but it is getting older and could end up costing you an arm and a leg if it has problems. I am getting rid of my 07 now because it is getting long in the touth. The M3 will be a great step up from that junk you are driving now and it is 2 years newer.

08 m3... i would defiently rule out the 06 m5 due to the expired warranty. 335 are nice too but if you really want the m3 get it. In the long run im sure you will be much happier with the decision you made

You want all the toys or do you prefer stripped M3's? That can make a difference.

If 40K is your ceiling, and you can't find an M3 under that limit, then forget it or wait until you have more than 40K.

If 40K is your limit, but you'd prefer to have a nice cushion of safety, then a 335 is a nice car. But if your heart is set on an M3, don't compromise on a 335 - your only choice is to wait... until you either find the right stripper M3, or you can raise your limit.

That one looks pretty clean and near your price range. 40k miles isn't too bad, looks like whoever had it is dumping it just before warranty. You have like 8k miles of warranty left on it so it's not a bad buy for that price.

Out of the cars you listed I'd go for the M3, but Porsche 996's are taking a nose dive in value right now and you could pick one of those up for about what you're looking to spend maybe even a turbo if you look hard enough. Don't know what you want to do with it (daily driver/pleasure car) but I loved my 996.

The car listed on eBay seems to have some nice options. Upgraded sound, CD Changer, Nav, Teck Pkg. etc. The car appears to be lowered but I could be wrong. Looks to be in nice shape in the photos as well. Being that it is so close to end of warranty, if you are even considering getting a BMW extended warranty for it I would call a local dealer with the vin# just to see if they can pull up history on it and make sure that the original warranty is still in tact. Front reflector mod done, maybe lowered, so what else? If anything major was done BMW might have history of it and that might help you make up your mind a bit easier. With those miles and no warranty you could be looking at spending some $$$ on it in the near future with the next service, brakes if needed etc. Buyer beware. Take all the proper steps checking out this car and if all checks out, and this is what you really want, get it.

Safest bet is an M3. A porsche or M5 might cost more in maintenance which could have been used to just purchase the M3 from the start.

I think you will be happier paying that amount for a 335i, at least it will be loaded.

Do you need a back seat? If not, I'd look at a Cayman or Cayman S. Both can be had in the 40K range; Cayman for about mid 30s. Love the M3, but the Cayman is something you should test drive first if you don't require a sedan or coupe with back seat.

If M3, 08, 6MT, stripper. The 335 I would avoid unless you want to be in the shop frequently with HPFP failures. Direct injection sounds wonderful, but the fuel pump is a known failure point, and carbon build up is severe once you get past 40K or so miles. (Just search the forums on these two issues....)
