Unfortunately, BMW has decided to restrict access to this color to the M3 Edition cars, and the X5 M and X6 M SUV's for now.
It's possible they may allow this color to be special ordered at some point after the 2010 model year, based on conversations I've had with the principle decision makers. There are no plans to incorporate this new color into the E92 LCI (life cycle improvement) mid-year update either. I wouldn't hold my breath, that this color will be allowed as a BMW Individual color option before 2011. (even if you paid the 5k paint surcharge)
