It's been a few days since delivery, but I didn't want to miss to congratulate Ken for finally getting his long awaited M3.
I am so glad for the happy end and you obviously enjoying your new ride!

As for pics, sorry, I been enjoying the car too much these days and havent taken too many. Im supposed to drive the IS350 to/from work, but I cant seem to do it. I also seem to have a problem with turning off the MDM button, just can't do it (and probably why my gas mileage is so shitty)

Pics are def long overdue, as I now have 900+ miles and added tint, GPS thunders, cf roundels. In addition to that, I have on order smoked tails and painted reflectors. Hopefully this weekend, I just got to time it right and take pics within an hour after washing Otherwise, it starts collecting dust and looking like crap.

It's on May 3. It would be great to see you there.

My Volvo S60R is "Magic Blue" (dark) and shows dust/dirt within a few minutes after washing. So, I know what you mean. But my steel gray metallic BMW stays pretty clean

p.s., where did you get the tint done? I'm looking for a good shop in LA or OC.

8 hours of reading over 2 days.

Amazing.

Congratulations on the car. Excellent exterior and interior color combo

what dealer gave a discount of 9k on an m3..also what dealer would give 6700 or so off an m3..you gotta be nuts..as much as the bs is on here about how they aren't selling..i have seen the report and they have sold more e92 and e90 m3's than the previous e46 m3..it is a fact..they are producing nearly double what they did with the e46 so yes more are out there..second the 335 was sold out so fast because it had a much much larger audience!!! much larger so you couldn't find them..well only the e92 really.

now you have so many waiting for the dct trans..and since it is coming out so close to the 6spd a lot of people are going to wait.

strange thing to the thread starter..why do people like you spend so much on a car and cheap out for a few grand and not get exactly what you want..in a few years you think it's gonna matter if you paid 60 or 65 for the car? it's gonna be worth more anyways with the extra options. i just don't get people who settle for the "deal" instead of spending a lousy few grand more for what they want...it's just absurd to me!! what is the diff? i have heard so many people on here say man i wish i would have just gotten what i wanted instead. i guess bmw has good salesmen to sucker you in.. one of the ways the m3 is getting a discount is b/c of the dealer demo's.. some didn't come with the idrive so you don't get the m mode capabilities..and the ride can get harsh..though i would have it at max settings all the time anyways. plus dealer demo's all have great discounts cause they get beaten to shit.without the idrive i would NOT get this car..you don't get the edc shocks without the idrive but they can be ordered separatly..but how the hell do you adjust them if you don't have idrive? just a shit situation i would have thought a company like bmw would have worked around..or maybe they are like me and LOVE IDRIVE and just said screw it!!! i bet they wanted to keep the base price down instead of having the $3700 package standard!!!

The hell are you smoking? Its not in my nature to belittle mentally challenged individuals, but judging from your comment and the rest of your post, reading comp is not your strong suit, lol.

This car is loaded with everything except extended leather, so Im not sure what the "cheap out" reference is in regards to. No shitty salesman had to talk me into this car (quite the opposite, read the thread). It has Idrive. It wasnt a dealer demo. If anything, the car is an upgrade in terms of options to what I originally had on order, which was AW/Black/Aluminum with DCT, Premium, 19s.

Most importantly, Im happy with the car and the way it comes equipped. The JB, while difficult to maintain is a stunning color. THE FR interior, I would have never ordered but like very much. Tech package....no explanation necessary, its a necessity. I did have concerns on owning a MT car for the first time, but guess what? I like it enough that my next car will be a MT as well.

I just bought mine on Ebay plus I am attorney

I just took delivery on my 2008 Silver M3 Sedan from South Dakota from an Ebay purchase. I didn't have any problems, but I strangely became very upset when I read your post. Scum dealership and BMW NA must know the game that the face of their organization is playing. They will do something. Keep us updated!! As for legal action, it might be better to let BMW NA intervene and save the lawyer bucks for mods. The argument for the dealership is that you did not put up any consideration (I'm on your side though) and you are out no $. But stick to your guns and best of luck...

you kidding me?

a buyer need not pay for a good (with consideration) just because goods are governed by article 2 of the ucc which typically holds merchants to a higher standard and provides standard rules & duties because goods are tangible and identifiable?

as far as i know, the difference with the ucc is that consideration is not required in 2 circumstances: a firm offer or modification. as far as the meat of the contract, kool aid will tell you, oh yeah, its relevant.

do you think anyone other than an attorney, prelaw or with sales experience understands what the hell you are talking about anyway?

I'm not sure what you're babbling about, but it's clear you don't know the Uniform Commercial Code, or where to look.

UCC section 2328(d) provides that the last bona fide bidder in a no reserve auction has the right to enforce the bid and require the seller to make the sale. And, apparently, no one here (mostly law students but a few lawyers), thought to look at the UCC. eBay conducts auctions, which are governed by the UCC. So, whether anybody knows or not isn't the point. There is law that governs the situation and Dooma350 was smart enough to find a lawyer who knew and who used to his benefit.

Getting back to the point of my prior post - "consideration" isn't an issue.

the ucc governs when a sale by auction (the transaction) is complete (by customary conduct).

even if the contract has been formed, to complete performance & finalize the contract, payment is still required even if a buyer has the right to enforce the sale. consideration is necessary in every contract. thats common sense. again i ask: what are you saying? that the buyer can enforce the sale yet need not pay or show proof of payment?

Dooma350 had a right to compel Husker to recognize his bid and sell to him. In order for Dooma to buy, he obviously had to come up with the money (and did). "Consideration" may have been involved in consummating the transaction, but it was not necessary to enforce the results of the auction and compel Husker to sell.

Dooma's lawyer had it exactly right. None of the other commentators knew what he was talking about (and would have failed a Bar examination question on the subject; it's not really very hard).
