"Tricky" is in the UK so subject to different BMW rules than you guys...there is no automatic free update to the latest software here, you need to demonstrate a problem to receive a software update under warranty.

Unfortunately I don't know of any way to read the software version outside of the dealer network.
If you can repeat your problem to your dealer then you should get an update...if not try another dealer?
