Dooma, glad to see that it seems to all be going your way!! I've only been reading this thread for <12hrs, but it has been an awesome story nonetheless. Can't wait to see what stipulations the dealer puts forth

Let me just say how mad I was to read this. I was very upset that they would do that. Dealers are very shady. I have an 04' Maxima (yes it is not a BMW but I joined because I wanted to type this) and my dealer is awful as well. They are the "best" in New Jersey however they suck. I've taken my car in under warranty numerous times and then they say nothing is wrong. Then something happens and I'm forced to call corporate and now they have to pay for my repairs...hmmm.

Anyway..just wanted to let you know I called Michael Barrett & left him a very nasty anonymous message yesterday pressuring him to sell it to you (if your reading this Barrett..hope you liked the message) and I wrote a very nasty anonymous email to them. Glad that everyone came together and I truly hope this $60k M3 Sedan is finalized. What an excellent car. Good luck with it. Hope your satisfied...I know we all are!

Also, after having read the replies above about them possibly shill bidding their auctions..I am going to investigate it. I have been on eBay for almost 10 years and know eBay like the back of my hand. I will then report any findings to eBay and they will be forced to have their dealer account suspended. What sweet revenge that would be.... You getting the M3 for $60k AND them getting their eBay account suspended..lol! BMW of Lincoln...better watch your backs!

Maybe I should consider bidding $60k for their 05' 325ci they have listed on eBay right now and once I win I'll just let them know it was a slight mistake and not to worry that I won't be able to buy it from them.

I am holding out on the congrats until I see pics of Dooma and his car. This may be a ploy to steal some momentum from the story. We all think it is over and then the contigency ends up costing him 6K.

It was 7 am in the morning here in Estonia, when I found this on the 2nd page of reddit. Been reading all day and finally got to the last page by now > half past midnight.

1st congrats dooma > you are just gonna love that car.

2nd > awesome post. Really interesting to read. The legal facts, interesting points about different aspects + some fun + slander

3rd > being a marketing, PR student - Since there are 2 BMW dealers in Nebraska - As the head of the marketing department of the other dealer, I would have just offered you one M3 with everything you wanted in the 1st place(right color etc.) for $60K or even cheaper. Just for the publicity alone. The other dealer would be double F'ed this way and you would have gotten an even better deal.

eBay doesn't truly care about their sellers. They recently enforced new policies which is already hurting sellers. There was an eBay Boycott for an entire week and eBay knew they were in trouble so they went ahead and made a 1 cent listing week to recover from their losses. A close friend of mine used to be a Top 100 PowerSeller on eBay ($3 million profit/year after $60,000 eBay fees a month..YES AN M3 PER MONTH IN EBAY FEES) and they were very rude to him and even threw him off eBay! They threw him off because they made an excuse that he was tampering with eBay although he never did any of that.

All in all, he is back on and they do not know that. But eBay just doesn't care about the sellers. They are horrible.

I live in seward 25 miles west of lincoln. I just called husker auto and a guy on the sales floor is telling me that they are honoring the ebay deal, not that they have to but they are. He said that they had there lawyers in there today and were told that they did not have to honor the auction because it was a mistake. but he did tell me that yes it is taken care of and the guy from california is going to get his car.

Glad to see things got resolved.

Only thing I can add is that for the sake of Dooma..people should immediately STOP calling or e-mailing the dealership.

This does not help Dooma and could jeopardize the sale if the dealer decides to go back to playing hardball.

As an Ebay seller, Dooma is very much in the right and mooseman is obviously from the dealership. His point of view is not valid, you cannot rip off sellers on Ebay. As a seller, you pick a starting price and set a reserve or don't set one. For example, I put my 100$ worth of aquarium equipment on ebay with a starting price of $10. I did this just as the dealer did in hopes people bidding it up. It was only bid up to 50$, unlike this dealership I did not tell the buyer sorry you didnt pay enough money and the price was a mistake. It's stated in ebays terms that its a contract, you wouldnt take your car to an auction house and when only 1 person bids the opening bid you dont jump into the car and gun it off the lot because you didnt want to sell it for that cheap, same thing with ebay.
Glad Dooma did get the car it sounds like. Fight these assholes to the death, you won fair and square according to ebay policy. They shouldnt list cars without a reserve if they truly dont want to let them go for a lower price.


Also with this post here:
"Specifically look at the "r***c" bidder. He bid on the GTO and the M3 auctions.

Then we have that "5***i" guy who bid on all 3 BMW auctions...

Look suspicious to me."

Not sure if someone cleared that up but ebay is now protecting the userid's of bidders, if you look at all auctions now it will have those kinds of userids listed in the bid history now.

You're a parasite who obviously can't read. The only "mistake" the dealer made was trying to screw the OP out of a car he legally won at auction. Lincoln BMW knew exactly what they were doing when the created an auction w/ no reserve.

Instead of being lazy and displaying your ignorance, read the entire thread next time and make an educated contribution.
