not entirely what I'm saying, but there is much more than meets the eye. Everyone jumps on Ins. Companies w/ out knowing much about the field and/or process.

Not true, but most often true. If you make an unsafe lane change and get rear ended, YOU are responsible-even though you are hit in the rear. The driver behind can be expected to follow a safe distance behind, but not with some of the morons who jump right in front at a back up in traffic.

Sorry to hear about your experience OP. Rest assured that you can also be hit in "not nice" cars. It probably isn't someone trying to get a closer look at the car, it is a group of idiots that don't care if they rear end you-they just want to get to work that much faster/keep someone else from cutting in front of them.

I have it happen on a daily basis and particularly cringe when the Expeditions stop about an inch from the rear bumper on my S2000. There isn't a lot of metal/crumple zone between the bumper and the back of my seat.

I doubt that the insurance lobby in Texas works any different from those in any other state, it just appears that they are far more effective in Texas.

How did they get that sort of law passed? There are all kinds of ways for an insurer to make it just difficult enough to avoid getting a statement within 30days-wrong mail address on website, phone center that is intentionally overloaded with long wait times, limited phone hours, etc. Make it difficult enough and someone with a busy job just might miss the window.

Been rear bumped on one of my M3's it's a pain in the neck I can attest to that.

My advice to everyone that get's bumped (this is for Canadians, I don't know what the laws are in the USA) a) exchange all information then b)drive to the Police Reporting Centre and have them make a report c)phone your insurance

Never settle privately it does not pay. I say this since in my case it looked like around $1000- damage ... When all was said and done the repair with tax was just over $3000- (there was hidden damage below the rear bumper, holding bracket broken etc.)

So be on guard after all the one behind you caused the damage and should pay you have enough with the inconvenience (getting estimates, phoning around, no car for a few days etc. etc.)

you prob dont realize that you have better brakes than the standard car and when a car is following you thinking theres open road a head of you its not easy for him to stop at the same pace as you.

This is a good point. When I have to stop quickly, I do so as slowly as I can (use all available room) to give the person behind me the most time and space to stop. I also am prepared to move into the shoulder or an adjacent lane if I see someone approaching quickly in the rear view.

Also, I leave extra room in front of me at stop lights, in case some jack#ss isnt paying attention.

California has many of these "nothing to lose" drivers, but thankfully, the insurance process is much better. GL OP.

i am shocked there is no 'uninsured motorist' coverage on your policy. there is on ours. sorry to hear about all the hassles, it's just not fair.

To be clear, I have UM coverage, but it does not apply when someone has insurance. The problem is that in all 3 rear end collisions in the last 2 years the insurance that these folks had was very very poor. These insurers provide the necessary coverage so their insured can get their auto registration. What these fly by night companies don't provide is coverage for the poor shmuck (me) that gets hit by their customers. That's the game, offer cheap insurance rates, and don't pay on claims. Simple formula. For those that doubt this, read all of my posts in this thread.

On a positive note, I need a new muffler and there is only one available in the entire USA, and my body shop secured it for me. At least I don't have to wait for BMW to ship it from Germany. While it seems incredible, I don't care, as long as I receive it on Monday.

Dropped off my car this morning at the body shop. I am in a rental and within 5 minutes of leaving the rental counter the car immediately in front of me slammed into the rear of the Land Rover which was in front of him. I pulled over to give my info to the guy in the Land Rover. Driving in Houston is a full contact sport.

KIS, hang in there buddy, that whole deal sucks. Many people end up with neck injuries, which show up days later, after they have been rear ended.

It has not been decided yet. The other guy's insurance takes 4-6 weeks to evaluate a claim. Plus they have 30 days to get a statement from their customer before they will act. Wonderful system. My car is being repaired through my insurance company and then they will subrogate the claim for damages.
