hey guys i need to vent but also take my experience and never go to valencia bmw. Last week i bought a 08 M3 from valencia bmw, i came in with my family and did the paperwork with my $20K cash down payment. The finance manager collected my money did all the paperwork and handed me the keys and we drove off the lot and a couple days later the finance director called and said they need us to come give the down payment check and i told him that i put my down payment alrealdy and got all my paperwork here with the car. But apparently the contract is not a receipt, i'm supposed to get a separate receipt? so yesterday they repo my car, what can i do? i've called a lawyer and he told me that there would be a case but the dealer is going to fight it due to the fact that they gonna believed their employee and if it goes to court its gonna be 6 months to a year for my case to be done and over with. Any suggestion?
So take it from my experience don't deal with valencia bmw, they're a bunch of thieves.

You gave them $20K in "cash" and not a "check" as a down payment? Hard to say since there isnt a paper trail and you might be SOL. Did the contract state that you put the $20k down payment before you sign? GL bro...hopefully everything works out.

on the contract it does say $20K cash down, and i finance $30K.

Don't you have any kind of record of this $20k in cash? What form was it in exactly? I'm assuming this wasn't just a big roll of $20's.

Also, if all went down as the OP stated, shouldn't there be a criminal case here (i.e., employee allegedly stole $20k from the OP)?

When you say that you paid in "cash" do you mean that you paid in actual dollar bills or with a check? If the latter, then you can at least see if anyone has attempted to deposit the check. If the former, I have to wonder what you were thinking giving anyone $20K in hard currency and not getting a receipt.

This is a strange story.

That's pretty wild man. Never heard of putting that much cash down (as opposed to cashier's check), and normally they'd give you a "cash receipt" with signatures, in either case. Hope you can get that straightened out.

1) why would you not make sure you have a receipt for handing over $20,000- in cash?
2) why would you even hand over $20,000- in cash and not go to your bank and have them make out a bank draft for the $20,000- in the name of the dealership?
3) if you had your bank made out a bank-draft for the $20,000- you would automatically have a receipt. The original would be for the dealer and a copy for you.
4) Your sales slip does not show the $20,000- as down payment and the balance to be financed?

and finally

Why would the dealer give you the key to the car and let you drive away if the $20,000- transaction of the down placement had not taken place.

Sorry my friend ... I hate to tell you this, however in this case .... as they say

"you made your own bed now you have to sleep in it"

Bottom Line ... you need to make sure you have all the paperwork and if you purchase a car again make sure you have a bank-draft or certified cheque made out to the dealership.

Something ... as others already stated does not add up here.

I wish you luck to straighten this out ... hope the guy that took your $20,000- still works there.

BTW. Must your financing not be approved before you pick up your car? Again why would the dealer give you the keys if not both transactions (downpayment and finance approval) are not 100% completed? The final signature for the vehicle release is always with the Sales Manager, only he is the one that can authorize the keys to be given to you. This sounds like a very grave story ... you best get a good lawyer and fast ... once again good luck to you.

i gave him 20k in hundreds, i've bought my e92 with 10k cash down also. he showed us the contract and said that here's what we put down and this is the amount we are financing and he ask us to sign and he sign it. do any of you know if they have a security camera in there so i can tell them to look at the camera to show that i gave him the money?

Cash as in cold cash? Not a check? If you used plain old cold cash, how did you transport the money, suit cases? If so, there should be some strong evidence in the dealers security cameras or something.

Either way Yikes, is all I have to say. If it was a check, it should be clear as day in your bank account of when or if anyone has cashed a check, if they lost the check, have the lost check canceled (via check#, etc) and re-write the check.

If you are saying that, you gave them 20k, and now 20k is gone, well that is a HUGE deal, that is get the police involved kind of a deal, that is hire a detective, and bring up a law suit for LOTS OF MONEY, kind of issue. If somebody walks into a dealership with $20,000, there is going to be a lot of buzz, a lot of counting and a lot of talk. The dealer can't simply make everyone disappear, or even the money...




The more I think about this, the more it sounds like fraud. As in, you are doing something fishy and trying to make 20k appear.

i didn't want my bank account to go over 5k in there at all time. (other reason)
i didn't want to sign a check cause that will have to go thru my bank.
in my contract it does state that it has the 20k cash down.
i know why would they let me drive off with all the paperwork and they car if i didn't put my down and finalize my paperwork.

To avoid the IRS flag? Definitely a drug deal gone bad, or more precisely, money laundering gone bad.

???? that's what im asking if anyone know if there's a security camera in the finance manager's office so i can tell them to look at that footage to show that i have him the envelope of money?
yeah i know this is fraud, the stupid manager just jack me 20k and i'm piss.
do i need a lawyer to get my money back?

i've been calling the GM all morning and they haven't return my calls. they're a 1 1/2 hr drive away.
